Details: The Reebok EasyTone class action lawsuit settlement will resolve an FTC complaint that Reebok made unsupported advertising claims that walking in its EasyTone shoes and running in its RunTone running shoes will strengthen and tone key leg and buttock muscles more than regular shoes.

The class action lawsuit took aim at Reebok’s specific advertising claims that walking in EasyTone footwear had been proven to lead to 28 percent more strength and tone in the buttock muscles, 11 percent more strength and tone in the hamstring muscles, and 11 percent more strength and tone in the calf muscles than regular walking shoes.

Under the Reebok EasyTone class action settlement, Reebok is barred from:
 
 -- Making claims that toning shoes and other toning apparel are effective in strengthening muscles, or that using the footwear will result in a specific percentage or amount of muscle toning or strengthening, unless the claims are true and backed by scientific evidence;
 
 -- Making any health or fitness-related efficacy claims for toning shoes and other toning apparel unless the claims are true and backed by scientific evidence; and

-- Misrepresenting any tests, studies, or research results regarding toning shoes and other toning apparel.

The Reebok EasyTone settlement will also provide refunds to consumers who purchased EasyTone shoes (including EasyTone Flip, RunTone, TrainTone, JumpTone, SimplyTone and SlimTone) and EasyTone apparel (including EasyTone Capri, Pants, Shorts, Long Bra Top, Sleeveless Shirt and Short Sleeve Top) from December 5, 2008 through October 12, 2011.

 

Class Members of the Reebok EasyTone class action settlement can receive $50 for each pair of eligible shoes, $40 for each EasyTone Capri and EasyTone Pants purchased, and $25 for each EasyTone Sleeveless Shirt, Long Bra Top and Short Sleeve Top purchased. These amounts could be more (up to double!) or less, depending on how many eligible claims are paid out.

No proof of purchase is necessary to file a claim unless you’re submitting a refund request of more than $200. However, you will have to sign under penalty of perjury that you actually purchased the products you’re claiming a refund for, so do not lie about the amount you purchased. I never received a letter and I am just learning about this suit. They are the most uncomfortable shoes I've ever worn. I've worn them ,Abe 2 times. Last time was for a walk and I ended up walking home in ky socks. I bought mine at Norstrom. They say they take everything back. I'll search for my receipt. I think it was in the box and I finally disposed of it. Any recommendations ????

I bet we could sue our attorney's for the remainder of what they owe us along with interest and penalties considering the deadline has passed. I bet that 10+ percent went into their pockets above and beyond what they charged us. I am going to consult an attorney to see if I can begin my efforts. @nancy, I moved also, but my check arrived today (in Ohio) with my correct address on it, and I didn't do anything to change it with the settlement firm. So I'm guessing that if you filed a proper change of address with the post office, you'll likely be OK.

FYI the check looks like a postcard when you open it it will be a check never seen a check like this........... ..seems every one will receive it but if your claim was more then $200 you will receive the $174.90 because i had over a $200 claim never received a letter in the mail but this card stats that claim was reduced on a pro-rata basis because claims exceeded available relief........

i heard for one of the claims admin clerks they flagged over 8,000 claims to turn over for investigation. I asked if those claims are being paid and she said yet but they'll have to return the money if the authorities prosecute. she said countless claims w/ same name w/ different addresses in very close proximity. odds are same person, which is why they those claims are being investigated. might be why getting our checks took so long.

Kristin, so long as you didn't get a notice, you'll get your check. And yes, it sucks that folks will take advantage of the system and ultimately, hurt those who really DID buy shoes. But if companies like Reebok were allowed to demand proof for everyone, there would be people who didn't have receipts but bought that would be totally shut out as well. That's why they usually mandate a figure to offset some of that (hence the $200). Just shows you there are people out there that will do anything in this environment to get some money.

I claimed for 4 pair of shoes.. and was not given a notice to prove my items (which I have).. So hoping for a bit!

Kristim K, I'd guess Mark went for $200 because $174 is 87% of 200. Stands to reason that most people who claimed that much will getting that amount. Considering there were 315,000 claimants for $25 million in damages, the average check will go for $79.36...the number is less than because there were more claimants than the average amount could pay out (which I think is ridiculous). Generally speaking, I'd imagine that the majority of people will get their checks Saturday or Monday, with people an intermediate distance from Minnesota getting them Friday.

Thanks Ginger; This is what it states: The amount each consumer gets back is based on the amount the consumer claimed to have spent on the products. Consumers will receive approximately 87 percent of the amount on their claim forms that was submitted and approved. The deadline for filing a refund request has expired. Under the terms of the FTC settlement, the funds were made available through a court-approved class action lawsuit. Rust Consulting, Inc., the court approved settlement administrator, will begin mailing the checks on August 8, 2012 to eligible consumers who submitted a valid claim for a refund. The checks must be cashed on or before November 6, 2012. Consumers who have questions should call 1-888-398-5389.

I did a few weeks ago and was told that NO CHECKS had been mailed. Even asked why some are saying they had received a check. The guy said those are not accurate statements. Anyways....the 8th is fast approaching....

I would have thought they would have came by now. They have approx 8-9 business days left to get them mailed. The aug 8th deadline means that it is the last day they have to put the checks in the mail. But usually they will send them out ahead of time so that everyone will receive their checks before the aug 8th deadline to prevent alot of people from calling them asking where their check is on or after aug 8th. Its hard to say but im guessing checks might go out next week. I did find out today that all deficient claim letters have already been mailed, so if you did not receive one then your claim is valid.

got a letter of deficient claim saying i went over the 200, not true. This is a bunch of BS, I had moved from one state to the another and could not provide proof. I hope they start a class for people who received injury from these shoes, then I'll get more than 200. I spent a mint on these silly shoes hoping to improve my leg strength, never again!!! They say Aug 8th because that is their deadline, they do not want to be harassed about checks or having to track them until after that date. Checks will be mailed well before then.

Called the 888 number today and spoke with "Gayle", who informed me that no checks have been mailed, however "letters of deficiency" have gone out, but that is the only correspondence. Told me not to expect the check until around August 8th, as NONE have been mailed!

If you didn't get a letter in the mail in may that means that your claim is good nd everthing is going well and you claim is under 200.00USD. Your making them work slow because of all this nd everyone has to pay for it. That can't send your money out after aug 8 only before as they say. If so the you could put a lawsuit on them nd get a lot more money then you think just let them fuck them selfs if they want to play because at the end of the day your game is bigger they can't do that by law.

So the admin wait's until the 120 day mark to send checks? So by law they wait till the last day so they can keep OUR money in their accounts to gain interest. Seems like we may have a class action against these attorney's if we don't receive portions of that interest payout , am I right? In case of the Deifient notice there is a way you can still get your money. But you have to take the time to read in to the case nd paper work to know that. If you take the time a chill out for a sec it tells you wat you need to do. The administrators are just doing their jobs nd working hard to get you your money. Every comment I read knowing the law will just put you in a bad place they already got their money and won the case so let them pay you out and move on no need for all that it just takes time. If you got a letter mailed out on may 18th then do as the paper say and get you money.

I received a similar notice of a Deficient Claim. There was an issue with the Claim website back in feb where if you put 2 pairs of shoes- it showed 11 pairs. I called the Customer Service number in Feb and let them know of the issue. I called today- and they had no record of my phone call.

Reebok Administrator are know mailing out letters of Notice of Deficient Claim and requesting proof of purchase, stating that an individual have submitted a claim over $200. This is not right when you knowing submitted a claim that was less than $200. These lawyers are full of you know what??

Well they say it's no sooner than 10 days after the end of the period (April 10th), so at the EARLIEST, they would start processing stuff on April 20th. It can be as much as 120 days...so realistically, it won't be until summer likely.

You can not get a claim form online, because it does not allow you and also you can't speak to a live person when you call the number, this is some bull crap!
