At least a dozen institutional investors have opted out of a longstanding securities fraud class action lawsuit against Pfizer (NASDAQ: PFE) in order to secure larger judgments. The plaintiffs in the new case include the largest U.S. public pensions: the California Public Employees’ Retirement System (Calpers) and the California State Teachers' Retirement System (Calstrs); amongst other mutual funds.
Opting out of class action securities fraud lawsuits is increasingly common. This happens when plaintiffs of a larger class action decide that the risk of losing a separate case is worth the potential larger settlements available when they do not have to compete with smaller individual investors in the class.

Thousands of cases have been filed against Pfizer in the United States District Court for the Northern District of Alabama alleging that Chantix caused severe and unexpected side effects. With this many lawsuits over a single common cause the Judicial Panel on Multidistrict Litigation, JPML determined that the cases would benefit by consolidation into a Multi District Litigation (MDL) centered in Alabama.
MDLs offer significant advantages for both plaintiffs and defendants. By consolidating and coordinating federal cases into one court the parties can facilitate discovery by only requiring the defendant to produce documents once when requested. Additionally witnesses for the company only need to be deposed once. The court’s ability to review the bulk of cases also provides it with enough information about the typical issues that arise to provide consistent rulings. Judges overseeing MDLs like Chantix are also more willing to devote the time and resources necessary to resolve difficult legal issues when thousands of cases will be affected.

It has been reported that older patients taking certain epilepsy medications, such as Dilantin, are more likely to suffer fractures, according to a study recently published. Dilantin was one of the primary drugs cited in the study. In fact, every major epilepsy drug (with the exception of one) including popular Tegretol was linked to the increased risk of fracture in elderly patients.
Dilantin Reported to Have the Highest Side Effect Risk
The amount of the increased side effect risk of fractures varied based on the epilepsy drug, but Dilantin claimed the top spot with the highest risk of Dilantin fractures. Relatively mild side effect risk increases of 24% were shown with clonazepam-based drugs. This class includes Klonopin and Valpax. Dilantin’s side effect risk increase was far more substantial, with the susceptibility for fracture increasing by 91%.

When one sees the ingredient list for a homeopathic remedy like Homeolab USA Kids Relief Cough & Cold, it may seem very confusing. Things are not labeled in milligrams or ounces, but rather with C’s and Xs’. It may be confusing, but understanding the actual ratios will help to explain why some people believe these products are homeopathic scams.
Arnica Montana is listed at 3C, as is Bryonia. This actually means that they contain one microgram per milliliter, or 0.1 milligrams per each bottle. For reference, a similar bottle of cough syrup with non-homeopathic ingredients would contain 100 milligrams of cough suppressant and 2000 milligrams of expectorant chemicals. There is no indication that these materials would work so well in much tinier concentrations. All of the other ingredients are listed as less than one milligram.

A federal judge has preliminarily approved a class action lawsuit settlement with Pella Corporation over allegations its ProLine series of windows are defective and allow water to seep in and rot the surrounding wood. Homeowners that have or had a structure containing Pella ProLine windows, casement or awning manufactured between 1991 and 2006 can receive a cash payment of up to $750 per structure, in addition to other class action settlement benefits.
The Pella ProLine settlement will resolve a 2006 class action lawsuit, titled Saltzman, et al. v. Pella Corp., et al., that alleges the windows contain a design defect that allows water to seep behind the aluminum cladding and cause wood rot. Many of these windows are no longer under warranty, so the class action lawsuit is hoping to remedy the losses Pella window owners suffered as well as to extend the ProLine windows’ warranty.
