Follow us on Twitter and Facebook for the latest Class Action Lawsuit Settlement News! Greek Yogurt False Advertising Lawsuits Belong to FDA, Judge Says By Sarah Pierce
A federal judge yesterday dismissed a class action lawsuit accusing General Mills and Yoplait of selling Greek yogurt that is “neither yogurt nor Greek,” saying the matter should be resolved by the U.S. Food and Drug Administration and not the courts.
Minnesota District Judge Susan Richard Nelson tossed the proposed Yoplait Greek yogurt class action lawsuit in which plaintiff Martin Taradejna claimed the companies knowingly misrepresented the quality of their product by using a cheap additive that is not among the permissible ingredients of yogurt set forth under FDA regulation. Judge Nelson said the FDA should settle the debate over what constitutes Greek yogurt and help end the growing number of similar false advertising class action lawsuits pending in other courts.

Follow us on Twitter and Facebook for the latest Pradaxa Class Action Lawsuit & Settlement News! What's the Real Deal with Pradaxa Safety? By Christina Drury
Pradaxa has been in the news recently for regularly causing side effects in patients – some that result in death. With over 500 Pradaxa-induced deaths in 2011 alone, Pradaxa has been a source of concern for many patients. The prescription drug is a blood thinner that is believed to have been rushed through the FDA approval process due to the need for an alternative to warfarin which has been tied to several claims of internal bleeding and subsequent injury. It appears that Pradaxa is no better, and with no antidote to reverse Pradaxa bleeding, it just might be worse.

Follow us on Twitter and Facebook for the latest Class Action Lawsuit Settlement News! New Class Proposed in Text Messaging Price-Fixing Class Action Lawsuit
By Mike Holter
An Illinois federal judge on Sunday asked plaintiffs to clarify the new class definition they submitted for the 2008 text messaging antitrust class action lawsuit that continues to plod its way through court.
Plaintiffs allege in the class action lawsuit, titled In Re: Text Messaging Antitrust Litigation, that AT&T Mobility LLC, Verizon Wireless LLC, Sprint Nextel Corp. and T-Mobile USA Inc. conspired to fix prices for text messaging. This alleged conspiracy was sparked by steeply falling costs, which prompted the four companies to exchange price information and increase their texting rates by one-third through a new pricing structure, according to the class action lawsuit.

Follow us on Twitter and Facebook for the latest Class Action Lawsuit Settlement News! Pfizer Hit with Securities Fraud Class Action Over Celebrex & Bextra By Michael Carlin
At least a dozen institutional investors have opted out of a longstanding securities fraud class action lawsuit against Pfizer (NASDAQ: PFE) in order to secure larger judgments. The plaintiffs in the new case include the largest U.S. public pensions: the California Public Employees’ Retirement System (Calpers) and the California State Teachers' Retirement System (Calstrs); amongst other mutual funds.
Opting out of class action securities fraud lawsuits is increasingly common. This happens when plaintiffs of a larger class action decide that the risk of losing a separate case is worth the potential larger settlements available when they do not have to compete with smaller individual investors in the class.

Follow us on Twitter and Facebook for the latest Chantix Suicide Class Action Lawsuit News! Lawsuits Alleging Chantix Side Effects Mount in Court By Michael Carlin
Thousands of cases have been filed against Pfizer in the United States District Court for the Northern District of Alabama alleging that Chantix caused severe and unexpected side effects. With this many lawsuits over a single common cause the Judicial Panel on Multidistrict Litigation, JPML determined that the cases would benefit by consolidation into a Multi District Litigation (MDL) centered in Alabama.
MDLs offer significant advantages for both plaintiffs and defendants. By consolidating and coordinating federal cases into one court the parties can facilitate discovery by only requiring the defendant to produce documents once when requested. Additionally witnesses for the company only need to be deposed once. The court’s ability to review the bulk of cases also provides it with enough information about the typical issues that arise to provide consistent rulings. Judges overseeing MDLs like Chantix are also more willing to devote the time and resources necessary to resolve difficult legal issues when thousands of cases will be affected.

Byron discovered he had a heart condition, was deemed unable to work, and because of an improper Unum disability insurance claim denial, he nearly became homeless.

Follow us on Twitter and Facebook for the latest Dilantin Class Action Lawsuit News! Dilantin Linked to Fractures & Other Side Effects
By Andrea Gressman
It has been reported that older patients taking certain epilepsy medications, such as Dilantin, are more likely to suffer fractures, according to a study recently published. Dilantin was one of the primary drugs cited in the study. In fact, every major epilepsy drug (with the exception of one) including popular Tegretol was linked to the increased risk of fracture in elderly patients.
Dilantin Reported to Have the Highest Side Effect Risk
The amount of the increased side effect risk of fractures varied based on the epilepsy drug, but Dilantin claimed the top spot with the highest risk of Dilantin fractures. Relatively mild side effect risk increases of 24% were shown with clonazepam-based drugs. This class includes Klonopin and Valpax. Dilantin’s side effect risk increase was far more substantial, with the susceptibility for fracture increasing by 91%.

Follow us on Twitter and Facebook for the latest Zoloft Birth Defect Class Action Lawsuit News! Parents File Effexor Birth Defect Lawsuit in Montana By Andrea Gressman As a patient you typically trust that the prescription you are being prescribed by your trusted doctor is safe for you to use, but that is not necessarily the situation when it comes to SSRI antidepressants. When Lisa Rooney was pregnant with her daughter in 2009 she took an SSRI antidepressant known as Effexor XR and it probably never crossed her mind that the medication which had been prescribed to help her would cause so much harm to her infant daughter.
In an October 3, 2012 report by The Montana Standard as well as the Associated Press (AP), it was reported that Montana couple Lisa Rooney and Wayne Halvorsen recently filed an SSRI antidepressant birth defect lawsuit after their infant daughter was born in 2009 with extensive birth defects as a result of Ms. Rooney taking Effexor during her pregnancy. The SSRI antidepressant birth defects lawsuit states that a heart defect was developed in the baby girl because of the pregnancy side effects caused by Effexor.
