Lance Armstrong Book Readers File Class Action Lawsuit

The fallout from Lance Armstrong’s doping scandal continues for the Tour de France winner, who has just been hit with a class action lawsuit alleging his inspirational books were deceptively marketed as truthful biographies. The false advertising lawsuit claims Armstrong deceived readers by vehemently denying he used performance-enhancing drugs in his books “It’s Not about the Bike” and “Every Second Counts,” and now they want their money back.
The crux of the false advertising class action lawsuit is that the books were marketed as “nonfiction works.” This constitutes a violation of the Consumer Legal Remedies Act, the Unfair Competition Law and the False Advertising Law, according to the complaint.
Plaintiffs Rob Stutzman and Jonathan Wheeler say they and others “would not have purchased the books had they known the true facts concerning Armstrong’s misconduct and his admitted involvement in a sports doping scandal.”
Armstrong denied he used performance-enhancing drugs for years, but finally admitted to using banned substances last week in a televised interview with Oprah.
The Lance Armstrong book class action lawsuit also names as defendants Penguin Group, Random House and other book publishers that produced the titles.
Stutzman and Wheeler are seeking restitution, refunds and more for a proposed class of all California residents who purchased the books.
