Target Text Spam Class Action Lawsuit

Target Target sends unsolicited text messages to consumers’ cell phones in violation of federal law, according to a class action lawsuit filed Friday.

Plaintiff Kenneth Hill alleges in the Target text spam class action lawsuit that the retailer used a third-party company to conduct a marketing campaign that included sending unsolicited text advertisements to cell phones users across the country. Hill was one of those consumers, despite not having done business with the store in over a year and a half and never making an inquiry into Target’s products or services, according to his complaint.


“By effectuating these unauthorized text message calls … defendant has caused consumers actual harm, not only because consumers were subjected to the aggravation that necessarily accompanies wireless spam, but also because consumers frequently have to pay their cell phone service providers for the receipt of such wireless spam,” the class action lawsuit states.

Hill alleges the Target text messages violated the federal Telephone Consumer Protection Act (TCPA), which prohibits companies from contacting consumers on their cell phone without prior express permission.

TCPA class action lawsuits and settlements have been cropping up repeatedly over the past few years as consumers learn their rights. A TCPA class action settlement can mean big bucks for recipients of text spam, as the law carries stiff penalties for violations. For example, a recent Steve Madden Text Spam Settlement provides up to $150 cash to people who received an unsolicited text from the company.  Consumers who received a text ad from Lucky Brand Dungarees can receive up to $100 cash from the Lucky Brand Text Settlement.

Hill is seeking to represent all consumers who received one or more text message advertisements sent on behalf of Target.

The Target Text Spam Class Action Lawsuit case is Kenneth Hill v. Target Corp., Case No. 13-cv-00041, U.S. District Court for the Eastern District of Oklahoma.

    My family and I received numerous ones but we never opened the link in them as online research showed they were not actually from target but actually a phishing attempt and NOT from Target….
