Details: Fairly simple as claims go. Did you receive text messages advertising Timberland.com? If you did then you may be eligible to submit a claim.Head over to the Settlement Administrator Website, Click on Claim Form (left hand side menu), select the option you prefer, filing it online or printing out a customized PDF and sending it in via snail mail (USPS.) Our experience is that it's easiest to use the online option whenever possible. If you have any difficulties, call the Settlement Administrator at the number listed above. They will be able to walk you through the claim process. You enter in all of the standard name, address, phone and other contact info then you have to check the months you received text messages advertising Timberland.com. Reading through the legal brief the messages seem to have been sent largely from September through December 2005 though the claim covers all messages sent between January 1st, 2003 and August 1, 2008. Make sure you check the appropriate month(s) you received the messages. List the cell phone number(s) you received the messages and certify that all of the information you listed is correct and submit the form. That's it! Easy as that you're up $150 or whatever the percentage is of the amount left over in the settlement fund when the claims are paid out. Purchased From: All persons residing in the United States who, between January 1, 2003 and August 1, 2008, received a text message advertising the sale of goods on Timberland.com Claims Accepted Until (YOU MUST SUBMIT YOUR CLAIM BY THIS DATE!): February 2, 2009 Class Action Lawsuit Settlement Amount(s): $7,00,000 minus $1,750,000 in Attorney Fees minus $5,000 to representative (lead) plaintiff counsel Jeffrey Weinstein and $10,000 to representative (lead) plaintiff Lei Shen minus administrative costs (advertising the notice, settlement administrator expenses, etc.) TCA Staff Tidbit: Holy moly, what a settlement! $150 to each claimant (if the fund isn't maxed out in which case you'll get less than that) for filling out the form certifying you received text messages advertising Timberland.com during the dates listed above. Wow. That's pretty sweet for the consumer who was bombarded with WiSpam (I'm trademarking that, don't steal it! ;) on their mobile phone, blackberry or maybe even iPhone. Surprisingly they state in the long form settlement paperwork that the messages were largely centered in Illinois and from September through December 2007, but they opened this up to everyone nationwide. If you received one of these messages, make sure to submit your claim! It's super easy online and for the record only $200,000 of the settlement fund is going to charity so don't be shy about making your claim. Any left over funds go right back into the defendants pockets. Around these parts out West, we're not big on Spammers, so file your claim!

Payment for claims typically don't go out until 3 - 6 months after the settlement has closed. If the settlement is challenged it can take even longer. In this case checks will likely go out in the second half of 2009.

I filled out a form for my portion of the Timberland "unsolicited texting" lawsuit back in September of 2008 and I have yet to hear from them. I filled out the form online. What gives? Please assist.
