Details: Relatively easy settlement to submit your claim for if you have an impacted iPod Nano. Head over to the Settlement Administrator website and click on "Claim Form Request." You will be required to enter in your Serial Number, verify the text shown on the page and click on "Submit." They'll now tell you whether you qualify to make a claim in the settlement and how much you'll receive. If you qualify you'll receive $25 if you didn't get a slip case with your iPod Nano or $15 if they included a slip case. Fill out your information, print out your form, sign it and mail it in. It's very important that you sign the form. Your claim will likely be automatically denied if you fail to sign or date it. Any questions? Just give the settlement administrators a call for help.

Purchased From: Any 1st Generation iPod Nano which has a serial number which matches those listed by Apple as impacted by the manufacturing defect, regardless of purchase date, is covered by this settlement. The unprotected iPod Nanos started selling in 9/2006. Apple started selling protected iPod Nanos in 12/2006. Enter in your Serial Number at the Settlement Administrator's website to see if YOU qualify even if you bought your Nano after 12/2006. Old stock may have sat on the shelves or a warehouse after 12/06.

Class Action Lawsuit Settlement Amount(s): $22,500,000 minus $4,500,000 in attorney fees minus $27,500 in the lead plaintiff rewards minus $200,000 in litigation expenses minus unknown administrative costs (advertising the notice, settlement administrator expenses, etc.) = $17,772,500 to be distributed to class members. TCA Staff Tidbit: This case is receiving a fair bit of controversy in the various Apple Forums out there. Many are saying "Why should I make a claim? It worked and I loved it! Sure it scratched easily but I still used it. I'm not going to take Apple's money! Heck with those lawyers getting millions for a scratched iPod!" They then genuflect to their iMac while making the form of the cross with their 2nd Generation iPhone, jump into their Prius, and hit the Farmer's Market for some organic produce. OK, so maybe I'm being a little bit overboard but I see their point.

They used it and liked it, so why make their claim? Simple. Apple settled this class action lawsuit because they SHOULD have put on the protective coating when the Nano was released, but didn't, for whatever reason. Any of the Apple Dedicants out there will agree with that statement. The Nano shouldn't have been released without the coating. Many of those same people are HAPPY to leave money sitting on the table but I don't think they're considering all of the facts. Keep in mind that the class action lawsuit settlement agreement stipulates that Apple won't get a PENNY of the settlement back. You won't be helping the AAPL stock price by not making a claim in this class action lawsuit settlement. Anything left over in the Fund goes to charity. Because that is the case, I say, if you don't need that $25, by all means don't make your claim and let it go to charity. The problem is that in today's economy, most of us out there can use $25 for a tank of gas or half of a casual dinner for two. If you were impacted by this settlement we encourage you to make your claim. You won't be helping Apple in any way by not making your claim. If you don't need the cash leave it on the table and be charitable in an indirect way but don't think you're doing Apple a favor. You aren't.There's very little chance that there won't be enough claimants to pay out the case or for it to be challenged. Make your claim now!
