Details: The TD Ameritrade class action lawsuit settlement will resolve allegations that TD Ameritrade failed to protect consumers from a data breach that resulted in their email addresses being stolen and used to send them unsolicited spam emails promoting certain stocks. TD Ameritrade continues to assert that the data breach, which was discovered and corrected in 2007, has not caused any class member to experience identity theft. However, sometimes the cause of a particular instance of identity theft can be difficult to determine and may never be known with certainty. Therefore, TD Ameritrade agreed to pay a maximum $6.5 million class action settlement to provide benefits to all those possibly affected by the 2007 TD Ameritrade data breach.

The Ameritrade settlement class includes all persons who are or were account holders or prospective account holders and who provided physical mailing, postal or email addresses to TD Ameritrade, Inc. on or before September 14, 2007.

The TD Ameritrade class action settlement provides a range of compensation to class members:

(1) If the only identity theft you experienced involves an existing credit or debit card account, you can claim $50.

(2) If you experienced identity theft involving a new account or existing account other than an existing credit or debit card account, you can claim: (a) $250; or (b) any amount up to $1,000 (inclusive of the $250 minimum payment) if and to the extent that you incurred and are also claiming out-of-pocket expenses; or (c) any amount up to $2,000 (inclusive of the $250 minimum payment and out-of-pocket expenses of up to $1,000) if and to the extent that you incurred and are also claiming unreimbursed losses on the account(s) involved in the identity theft.

In order to receive any of these cash benefits from the TD Ameritrade data breach settlement, you must submit a claim form and any supporting documentation by midnight, Pacific Time, on July 6, 2011.
