Details: The proposed HP Elite desktop settlement will settle a class action lawsuit, titled Kent, et al. v. Hewlett-Packard Co., that alleges certain HP Pavilion Elite series desktop computers are defective and prone to frequent failures. The alleged symptoms of such failures include, among others, the system becoming unresponsive or locking up within 30 minutes of a cold boot. HP denies these claims but has agreed to provide free repairs, motherboard replacements or repair reimbursements to Class Members.
You’re considered a Class Member of the HP Pavilion Elite desktop class action settlement if you purchased, leased, received as a gift or otherwise acquired in the United States one of the following HP Pavilion Elite desktop computer models:
e9150t
e9180f
e9180t
m9600t
m9650f
e9280f
e9280t
e9290f
As a Class Member, you can receive one of the following benefits from the proposed HP Elite desktop settlement:
The Repair Remedy. If the Court approves the proposed HP settlement, HP will implement a 90-day limited service enhancement program. Settlement Class Members whose original one-year HP Limited Warranty has expired and who have experienced or who, during the this service enhancement period, experience a Lockup Failure or Blue Screen Failure can receive a free motherboard replacement by contacting HP on or before the last day of the Service Enhancement Period. Settlement Class Members whose Affected Model is still covered by HP’s one-year Limited Warranty can receive any necessary repair (including any necessary motherboard replacement) free of charge pursuant to that warranty.
The Reimbursement Remedy. HP will reimburse Settlement Class Members who paid HP or an authorized HP service provider to repair a Lockup Failure or Blue Screen Failure in an Affected Model before the limited service enhancement program was available. To receive the Reimbursement Remedy, you must submit a valid claim form and proof that you’re a member of the Settlement Class and that you paid HP or an authorized HP service provider to repair a Lockup Failure or Blue Screen Failure in an Affected Model before the limited service enhancement program was available. Acceptable proof includes a receipt, invoice, credit card statement or cancelled check, and must include the amount of the payment.
HP Settlement Class Members who did not receive a Notice directly by email or mail without requesting it must also submit proof of purchase of an Affected Model in the form of a receipt, invoice, purchase order or credit card statement.
To get your reimbursement from the HP Elite class action settlement, you must submit a completed claim form along with proof of payment for an eligible repair by August 28, 2011. No claim form is necessary to receive your free repair. If the Court approves the proposed settlement, HP will post on its website a notice about the repair program with instructions on how to make eligible arrangements to receive a repair. You will have 90 days after this notice is posted to contact HP to receive the Repair Remedy.
