A settlement has been reached in a class action lawsuit that alleges Upscale Events by Mosaic LLC (d/b/a The Mosaic Group) and Palm Beach Mall Holdings LLC sent unauthorized text messages to cell phones without receiving prior express consent to do so. If you were sent a text message promoting a job fair for the New Palm Beach Mall in August 2012, you may be entitled to a $150 payment from the class action settlement.

Who’s Eligible

Class Members of the Palm Beach Mall text message settlement include all individuals within the United States who received a text message promoting an Aug. 21, 2012 job fair for the New Palm Beach Mall, sent by or behalf of the defendants in August 2012, without having provided either company prior express consent.

The only way to receive a payment from the Palm Beach Mall text message class action settlement is to submit a Claim Form, electronically or by mail, postmarked no later than April 12, 2014.

Potential Award

Up to $150. The exact amount of the award will depend on the total number of valid claims that are filed.

Proof of Purchase

Class Members must provide the cell phone number that received the text message.

Lanza v. Upscale Events by Mosaic LLC, et al., Case No. 13-cv-80093, in the U.S. District Court for the Southern District of Florida.

Case Summary

The settlement will resolve a class action lawsuit (Lanza v. Upscale Events by Mosaic LLC, et al.) that accused the defendants of sending text messages in August 2012 without first obtaining express consent to do so. The defendants have agreed to pay up to $6.5 million to settle the litigation.

The defendants have denied that they violated the law, but agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

    Got a letter saying my claim was being denied not on the list..this is BS. Have no proof but I do know I had gotten texts. It happened in FL and I’m in FL. Funny how FL people are being denied yet claims from all over the place are being paid…REALLY? Must be RUST!
