diamond wireless FACTA class action lawsuit

Diamond Wireless LLC has agreed to pay $1.25 million to settle a class action lawsuit over printed receipts that contained consumers’ credit and debit card expiration dates in violation of the Fair and Accurate Credit Transactions Act (FACTA). If you used a credit or debit card at Diamond Wireless between April 24, 2011 and July 30, 2013, you could benefit from a class action settlement.

Who’s Eligible

Class Members of the Diamond Wireless FACTA settlement include all individuals who used a credit or debit card to make a purchase at a Diamond Wireless retail location between April 24, 2011 and July 30, 2013.

Potential Award

Diamond Wireless has agreed to create a Settlement Fund of $1.25 million, which will be divided equally among Class Members after fees and costs are deducted. Class Members who submit a valid Claim Form will likely receive between $25 and $50, but could potentially receive up to a maximum payment of $500. The actual amount paid out will depend on the number of Class Members who submit valid Claim Forms.

Proof of Purchase

Class Members must submit a Claim Form indicating, under the penalty of perjury, that they made at least one purchase or transaction at a Diamond Wireless Location between April 24, 2011 and July 30, 2013 using a credit or debit card.

Claim Form Deadline

4/8/2014

    • Jack Bauer July 18, 2014

This could be why there are no checks yet..i looked and couldn’t find a written order from the judge.
UPDATE: At a hearing on June 10, 2014, the Court approved the settlement. However, the settlement checks cannot be processed and mailed until the Court issues a final written order. The parties are not sure when that order will be issued. The website will be updated once the order has been issued. Thank you for your patience.
