Details:Clearwire Corporation has reached a class action lawsuit settlement to resolve customer allegations that its Internet speeds were slower than advertised and that it prevented customers from terminating their contracts despite providing poor Internet and phone service. If approved, the Clearwire class action settlement will provide credits to current customers and cash payments to former customers who file a timely Claim Form.

The Clearwire settlement will resolve two class action lawsuits, entitled Dennings v. Clearwire Corp. and Newton v. Clearwire Corp., that claimed, among other things, that Clearwire misrepresented its Internet service speed, intentionally slowed customers’ Internet service speeds without proper disclosure, provided poor Internet and phone service and/or imposed early termination fees (“ETFs”) that prevented customers from terminating despite poor service or required them to pay the ETF.

Clearwire denies the allegations but has agreed to a class action lawsuit settlement to avoid the expense of further litigation.

Class Members of the Clearwire class action lawsuit settlement include all persons or entities that purchased Clearwire’s retail services between November 14, 2004 and February 27, 2012 and provided Clearwire with a billing address in the United States.

Under the proposed Clearwire Internet class action lawsuit settlement, Clearwire will provide credits (to current customers) or make payments (to former customers) who submit a valid Claim Form by January 9, 2013. The amount of money or credit you can receive from the Clearwire settlement will depend upon which Settlement Group you fall into:

Group 1. Eligible Claimants who paid an ETF to Clearwire after cancellation due to concerns over service quality will receive 50% of the amount of the ETF paid;

Group 2. Eligible Claimants who initiated Clearwire service before September 1, 2010 and who experienced impaired Internet speeds and believe Clearwire was responsible will receive (i) $14.00 plus (ii) the following amounts for each month of service prior to February 27, 2012 during which Clearwire’s records show it managed the Eligible Claimant’s Internet speed at one of the following levels for at least one hour in the aggregate for that month: (A) 0.25 Mbps: $5.00; (B) 0.60 Mbps: $3.00; (C) 1.0 Mbps: $2.00.

Group 3. Eligible Claimants who initiated Clearwire service on or after September 1, 2010 and who experienced impaired Internet speeds and believe Clearwire was responsible will receive the following amounts for each month of service prior to February 27, 2012 during which Clearwire’s records show it managed the Eligible Claimant’s Internet speed at one of the following levels for at least one hour in the aggregate for that month: (A) 0.25 Mbps: $5.00; (B) 0.60 Mbps: $3.00; (C) 1.0 Mbps: $2.00. Group 3 Eligible Claimants will receive no less than $7.00, without regard to the number of months (if any) during which Clearwire managed their Internet speed.

The only way to obtain a cash payment or credit from the Clearwire Internet class action settlement is to file a claim form online at www.DenningsSettlement.com or mail it to the Settlement Administrator. Claim Forms must be submitted or postmarked no later than January 9, 2013.

    I just noticed by coincidence that they put me on a contract without notifying me –email, phone, letter, when I started was for the very same reason I HATE CONTRACTS, any of this included in the lawsuit? they say that I agreed to them changing terms as they please on their website and that was effective october 12, yesterday.

    YA I FILED AND HAVE HEARD NOTHING BACK THERE USB CRASHES N THERE SPEED IS SLOW I EVEN HAD TO CALL THEM TO LET THEM NO THE USB STICK CRASHES EVERY 45 MIN AND SPEED IS SLOW NOIT 4 G NEVER HAS BEEN 4 G SO GIVE ME MY REFIUND OF 50 PER MOTH SINCE I BEEN WITH THEN SINCE THE BEGINING OF 2012 THEN THEY ADVERTISE SAME STICK TO NEW CUST OMERS FOR LESS VALUE THEN YOU BEING CHARGED FOR TOTALLY UNFAIR SAYING U DONT QUALIFY

    Their internet speed is barely above dial-up forcing higher bandwith usage which they have penalized me for by terminating my service on an “Unlimited 4G” plan. Nice, huh?

    P bpought the 4g for my laptop and then the 4g broke. They put in an order for a new one; and now this one doesn’t even work. I haven’t returned it to the clear store yet. But I will. Anyone who purchases this 4g will be in for a surprise. I will cancel my contract and stop them from charging me 46.86 a month. This is a piece of garbage.

    I am a current user since Sept 2012 and I can tell you righ now that it seems like they are still throttling their speeds because I am getting download speeds of .15mbps nowhere near what I am paying for and all I am told is to keep readjusting my modem or I am too far from a tower…Seriously

    My husband bought the iphone 5 and Ipad for himself and he explained to them that he doesn’t want his plan to change. I have the thunderbolt 4g and I have internet access. I can multi task with my phone. Verizon told my husband that the good thing about the iphone 5 and ipad is that he can view the same thing on both and multitask. All he has to do was put in a password on the Clearwire service and they set him up. I thought that was strange and asked him did they change your plan he said no. There was no explanation about this service or charges except that this is what it does. Now we already had internet on the original plan. Now my phone keeps crashing. If I’m listening to music and make a call it crashes. If I’m listening to music a viewing my emails it craches. What the hell is going on, I went to verizon they said my plan is the same I get an email and it says my plan is changed. I can’t even look at my bill on line because now there is a problem with my password. How do they trick people into this when there is a class action lawsuit. Seriously?

    I just saw deadline for claims didn’t even know this was going on…..I also have a tower less than a mile away from my home and service is bad….had multiple devices exchanged by clearwire same problem my service devices allows up to 5 devices to share hotspot that’s not true cause it never connects ….I’m very disappointed that I was not aware of what’s going one here…etc

    My wife and I have had clearwire since 2008 and we had no idea that there was a lawsuit that had even been filed. we were never notified. We have had nothing but problems out of this internet service and finally had to threaten to go to a different company to get anything done at all. Now, once again, we are having problems out of the hotspot that my wife has. Is there anything that we can do since the deadline has passed. We were never notified that there was a suit against clearwire.

    I have also had an issue with Clear and have correspondence about the speed of the interned vs. the promised speed. I have them since 2008. I was also not notified of the suit.

    I’ve been a Clearwire customer since June 2012 and was not notified of this lawsuit. I have cancelled my plan and have it set to terminate next Friday because they’ve begun throttling my download speed to around 1Mbps when I’m promised 3-6. I haven’t reached 3Mbps in months.I don’t know that I ever got close to 6. They’re response to my complaints? Use less internet. Right, then charge me less!

    I believe there should be a class action lawsuit against Clear for requiring contract / commission employees to purchase the equipment they sold. We were not provided DEMO models to show. We were told to sell the actual models in our names in order to sell on the spot. I had to purchase the equipment and service even when there was NO Clear service in my area. What a rip off.

    I too completed the necessary paperwork for the suit, filed it within the time frame and have heard nothing. Can someone update me please? Note: although they lost the law suit they continue with the same practices. I just got off the phone with tech support and was informed I needed to wait until there were fewer users on the tower. Seriously!

    I also filed within the appropriate time frame. So far I have received no payments. Looking at the settlement website it appears they last court document filed was as recent as 09/09/2013.

    Settlement order and final judgment was however entered 12/20/2012

    There are/were two different class actions regarding Clear wire. The kwan v. clearwire and the Dennings v. Clearwire. I recieved a check for the Kwan v. Clearwire about a month ago, this may be what Julie Stampers friend recieved. Recently I recieved a letter in regards to the Dennings v. Clearwire case askin me to provide more information, the form they provided was the same form I filled out for my claim, its deadline was to be returned by November 18 2013.Its my opinon that clearwire is trying every last trick they can to reduce the number of customers they will have to compensate.Dont give up.

    First, I am sorry for all the stuff you folks are going thru w/clearwire. I been a customer of theirs for years and only by accident did I discover that they were in the middle of a C,A,Suit. IM also sorry to inform you that the time to file a claim against them pertaining to the DENNINGSvsCLEARWIRE as well as the other one, (not sure the name) is closed.!Also, I been informed (ALSO NOT BY CLEARWIRE) that they are I believe being or have been bought out (or taken over somehow), but SPRINT now owns them.I accidently came across this info.as well! I had a hard time to get them to clarify this when I called about internet issues.I just happened upon this page w/surfing & felt like I should post what I know.I am tired of these “BIG-MONEY” companies taking advantage of people, myself included! God Bless & GOOD LUCK!!
