Details:Walgreens has agreed to pay nearly $6 million to settle FTC charges that it made deceptive advertising claims about its “Wal-Born” line of dietary supplements. If you purchased Wal-Born supplements between 2004 and 2010, you can apply for a cash refund of up to $30.

The Wal-Born settlement will resolve a 2010 lawsuit, titled Federal Trade Commission v. Walgreen Co., that alleges Walgreens deceptively advertised that its Wal-Born supplement line could effectively prevent colds, fight germs and boost the immune system. These supplements touted their similarity to supplements sold by Airborne Health, Inc., which settled similar deceptive advertising charges by the FTC in 2008.

Under the FTC Wal-Born settlement, Walgreens is banned from claiming that its products prevent or treat cold or flu symptoms, or protect against cold and flu viruses by boosting the immune system, unless there is scientific evidence to back up these claims.

Consumers who bought Wal-Born supplements between December 1, 2004 and March 29, 2010 can submit a claim for a refund. (Note: Some advertisements announcing the refund have incorrectly stated that consumers had to have purchased the supplements by June 30, 2009.) Consumers are eligible to receive up to $5 for each product purchased, for a total of six products or up to $30. The deadline to file a claim is February 4, 2013, and checks will be mailed no later than April 2013.

    This settlement, like so many of the others is complete bullshit. The one good thing about the FTC is that they are not receiving any money from the suit, it’s all consumer based. But they’re so tight lipped about when payments will be issued, it’s kinda annoying! I called last week and was told end of April, newest update is spring of 2013….vague as hell and this info I just got this morning! Wtf!

    I received a denial letter today as well. The validity of no one’s claim can be verified because you did not request receipts. So, now tell me, how do you determine the validity of the folks that you send refunds too? I purchase many items and I should be able to submit more than one claim to the FTC- where is it written that I Can’t. The FTC isn’t protecting the consumer!!!

    I also received a denial letter today. Something seriously needs to be done. I received my Reebok, but haven’t even got a denial letter for Skecher’s let alone a check. I have called, but have to work so can not hold for 99 mins for the Skecher’s. I left a number to be called back on…they called & very conveniently got disconnected. I filed a complaint with the Consumer Product Safety 2 years ago about the Skecher’s but still have received nothing. Let’s file a class action against whoever we need to.

    That’s a crock of sh!t. How can the FTC tell I didn’t purchase Wal-Born and threaten perjury charges. They also denied my Skechers claim. I’m sure my New Balance and Ab Circle Pro claim will be denied as well even though I have the shoes and the crappy exercise machine sitting in my house.     I also received the rejection letter trying to threaten me. I bought a TON of this product over the past few years and my claim was 100% legit. I didn’t get anything from the Skechers settlement either and I also bought AND paid for those. I think it’s disgusting how they are handling this. Is there anything that we can do? Normally I wouldn’t care but to me, this is deceitful on their part. I am sure that thousands of false claims were submitted but if they wanted to avoid that, they should have asked for receipts. I bought these honestly and only submitted what I actually BOUGHT. Total BS!

    I called the 800 number the agent I spoke with said she was told to tell anybody that called that, “claims you file are submitted under penalty of perjury”. I told her that’s exactly what the letter said. She pulled up my file and did tell me that I had only submitted one claim and that’s what she had showing….but could not explain the letter, the agent said someone would look into it and call me back.

    I also received a denial letter for Walborn. I received a check on the Reebok, but not the Skechers. I didn’t call the # because it seems like it would be a lost cause. They’re not going to correct anything. I thought the FTC was FOR the consumers, not against. I don’t keep receipts. I buy too much stuff to do that, especially as far back as these suits go. When we submit a claim and it says NO PROOF OF PURCHASE REQUIRED, and then the claim gets denied, that makes NO SENSE! They have no proof that WE DIDN’T BUY IT!!!

    I received a call back today….and was told my claim was denied because the validity of my claim could not be verified? When I asked for more information, “Lacy” told me it was rejected because I had filed 2-3 claims so my claim was rejected. They did say if I mailed in proof of purchase they would re-review my claim.

    A friend of mine received his check today for FTC VS children’s vitamins. Of course I didn’t. I did not get a denial letter, only for walborn. So mow now skechers,walborn,children’s vitamin.     When speaking to women at this settlement administrator they have no clue who FTC is. They read what they were told to read in response to printed letter that half a million people got on top of being rejected for skechers. American people spend millions on product so settlement should pay according to agreed criteria. FTC has no right to do this and should be sued by some attorneys for doing this side by side with settlemnt administrator. Skechers I called yesterday and said half a million checks went out is also a lie , she checked mine and my sisters claim in diff states both are still rejected and no info available so they are still playing big blunders with people..

    I applaud you Brian. I feel FTC needs to have a Class Action Lawsuit, because many honest people did file valid claims and was denied without validation and for the Sketcher claims also. Many people didn’t receive a check; because the FTC felt that if anyone filed other claims on other products, they felt people wasn’t telling the truth. People buy different products all the time as gifts and for their household and themselves. This is Un justice and I am glad you filed. If your filing goes anywhere, I guarantee there will be a lot of people who would be behind you. Thanks for having the courage to move it forward; To the Honest people who filed valid claims; it’s like defamation of Character. FTC made a bad judgment call on however they made there decision of who gets checks and who don’t

    Because this was an FTC action, there’s not really a settlement agreement, but what’s called a Stipulated Judgement and Order (“Order”).

    The Order provides that Walgreens was to pay a $5.97 million judgement and that “all funds paid to the Commission or its agents to be used for equitable relief, including, bu not limited to, consumer redress, and any attendant expenses for the administration of such equitable relief… Any funds not used for such equitable relief shall be deposited to the Untied States treasury as disgorgement.”

    Typically, the settlement agreement spells out what a valid claim is, i.e “made under penalty of perjury with no proof of purchase required.” There’s nothing in the Order about the claims process, so the FTC made it up as they went along, even though the claims process only required a sworn statement. Rest assured that the claims admin make extra money on all those denials and phone calls, unless the FTC got a package deal, which is rare.

    The Order does state that “this Court shall retain jurisdiction of this matter for purposes of construction, modification, and enforcement of this Order.” so it is conceivable for someone to write to the court (Northern District of Illinois, Judge Ronald A. Guzman) and intervene in the case seeking modification or enforcement.

    FTC has nothing to do with rejection of claims.Claim administrators have database to see which name and address are filing multiple claims.They are blaming FTC. By rejecting muti filers they think they are avoiding multi filers. In case of FTC vs walgreen they found half a million multi filers claims and rejected them even for 30 dollars.Skechers they rejected 250,000 claims for same reason and more. DATA BASE is doing the tricks for them. Hope they get common sense before they get sued because what they are doing is exactly wrong manipulating peoples personal datas and abusing them .Now you know why we need snowdens.

    If your family name with address is on their database you are on their black targeted list. They will not approve your claim. will put it a side. They will not inform you at all.If you call GCG or Rust any admin they will send your message to headquarter in case of GCG in seattle and someone so called project leader will ask a low profile woman to call you saying your claim was not approved with B.S reasons.If you submitted receipts to prove you will be told it was inadequete and thus you are not qualified. Basically they are harrasing you and telling you will not be eligible BECAUSE you are on their targeted list. You can send receipts whats required but you will not get a positive answer period. Woman hs access to all your claims you filed in last 5 years on screen and see what you send they have photocopies of your receipts on screen and still will reject you which is unlawful but they are doing it . Someone is backing them to do this .Someday they will be sued big time for persuing this inequality and unjustice and using peoples private info for aqbuse. Medical related settlement claims they are denying with no response,eventho you have physicians, pharmacies or store receipts. WILL NOT ANSWER YOUR CLAIMS at all. Years go by you wont even know it.Abusing techquique at best GCG and Rust…

    Got a rejection letter today. This is ridiculous. Someone needs to advise the court that they are not paying as they agreed. I may have submitted more than one claim…..so? I have the proof I bought the products. This is Wrong.

    Never received rejection letter–just waiting for a check that they said they were going to send “this summer”. I have a comment about the comment that says it will take time to review before sending checks. There was no requirement to show proof of purchase- receipts don’t last long anymore. Just seems like stalling and keeping money for themselves as they do in other suits.

    when people sign up for these class actions they lose their right to sue walgreens for a check they receive from the lawsuit. The people who do not receive the check as promised will still have the right to sue walgreens by them selves or as a class action because the agreement they signed has been breached by not getting paid as promised. sue them (walgreens)

    I received my 30 dollar check from this settlement today in Arkansas. Not sure if there is anything to this ‘blacklisted’ issue, but I did legitimately receive checks for this settlement, sketchers and new balance. So, I don’t know what is going on with so many people with legitimate claims getting rejection letters..I hope the issue is resolved esp for those who sent in proof and were still rejected.
