Details: The Optimum Nutrition settlement will resolve a class action lawsuit titled Attlesey et al. v. Optimum Nutrition Inc. that alleged Optimum made deceptive claims about the plant-based enzyme “Aminogen” that are not supported by competent and reliable scientific evidence. This included the claim that Aminogen could “improve protein digestion and increase amino acid levels absorbed from dietary protein.”

Optimum Nutrition denies any wrongdoing but has agreed to establish a $1.4 million class action lawsuit settlement to pay out Class Members and resolve the litigation.

Class Members of the Optimum Nutrition class action settlement include U.S. consumers who purchased the following protein powder products containing Aminogen from January 1, 2008 until November 16, 2012:

Gold Standard 100% Whey
Gold Standard 100% Casein
Gold Standard 100% Egg
Platinum Hydrowhey
NitroCore 24
Whey Gold Medal
After Max
Pro Complex

Settlement Class Members are entitled to receive $16 for each product purchased, up to a maximum of 3 units per household. Each claim must be accompanied by an affirmation that such products were purchased, along with other requested information relating to the purchase of the product.

The only way to receive a refund from the Optimum Nutrition class action settlement is to submit a Claim Form postmarked on or before May 28, 2013.
