Details: If you’re a member of the class it’s possible you’ve received a notice in the mail already, but, if you moved you probably didn’t. No one in the Top Class Actions offices who have taken any of the medications listed in this class action lawsuit settlement have received one (but we’ve all moved in the past two years.) Check out the list of drugs here. Once you’ve verified that you have paid for the drug, either via a co-pay or in cash fill out the claim form and send it in. We would recommend including a credit card statement or a note from your Doctor stating you took the medication, but, it’s NOT required for your claim to be processed. If you don’t have documentation, just make sure to sign and date the claim form in section E (everyone must sign and date it anyway) but be prepared if you only receive payment for ONE prescription drug listed. Without documentation it appears that they will only honor the claim for one prescription drug. If you include a Doctor’s note stating you took X,Y, and Z drugs (listed here) between August 1, 2001 and March 15, 2005 (Co-Pay claimants) or August 1, 2001 and January 23,2009 (Cash Payor claimants) you should receive payment for every drug listed. We would recommend that your Doctor print out and sign a separate letter for each drug listed, specifically listing the date ranges they prescribed it. That way you are providing excellent documentation and your claim shouldn’t be challenged (though the possibility is always there.) That’s it!

Class Action Lawsuit Settlement Amount(s): $350,000,000 = $105,000,000 in attorney fees + $14,630,000 (Co-Pay Claimants) + $28,297,500 (Cash Payor Claimants) + $202,072,500 (Third Party Payors, HMOs, Health Insurance companies, etc. Claimants) – settlement administrator expenses (identifying and paying the class, estimated to be $60,000,000 to be taken out of each claimant fund proportionately)

TCA Staff Tidbit: This looks to be a significant payout with roughly $44,000,000 being divided among the consumer portion of the claimants. You’ll see many of the commonly prescribed drugs including Ambien, Allegra, Celebrex, Claritin, Cipro, Demerol, Femhrt, Flagyl, Flonase, Lipitor, Metrogel, Ovcon, Prevacid, Prozac, Prilosec, Ritlan, Valium and Zantac covered in this class action lawsuit settlement. I’m submitting my claim for Allegra and Claritin, is there one listed (listed here) you were prescribed? Remember, if you paid via a co-pay OR cash (OUCH!) you can make a claim in this lawsuit. The funny thing is that the formula for how much each claimant is to be paid isn’t listed ANYWHERE within the settlement paperwork. Trust us, we read through 300+ pages of court documents and it appears to be a state secret. Most likely, they’re just equally dividing the pot between all claimants depending on the number of claims each person makes so you could receive $20 or $300. It’s a complete crap shoot. We won’t know until they pay it out in a few months. Overall, this is a pretty easy claim process and should be well worth your while to make your claim. Just make sure to send in the Doc’s note for each prescription you’re claiming if claiming more than one and you should be all set. Keep an eye on your mailbox. If your claim gets challenged you’re given between 30 – 60 days to get them the documentation they are requesting, so do so. Once you submit your documentation claims are typically processed expediently and you receive a check within 60 days.
