Details: This is a fairly simple class action lawsuit settlement to make your claim on. Head over to the Settlement Administrator Website and click on file a claim. You can submit it electronically there. You even have the option of attaching pictures or scans of your invoice showing the charge if you are attaching documentation to your claim. If you don’t have the ability to scan documents or take pictures of your documentation and upload them (MAKE SURE IT’S READABLE ON YOUR COMPUTER!) then after you submit your claim online you’ll be required to print out the final confirmation page and mail that in, along with your paper documentation (copies only, keep the originals) to the Settlement Administrator. Within the electronic claim form you’ll need to include your T-Mobile phone number, the date range you were (or still are) a customer, date you were charged the ETF (if applicable), amount you were charged (if applicable), amount you paid (if applicable) and you’ll need to select which category you fit into. The categories are:

 

Category 1. $125 – Iif you submit documentation you were charged a Flat Rate ETF (Early Termination Fee) or you received a postcard from the Settlement Adminsitrator notifying you of the settlement.

Category 2. $25 – If you can’t submit proof and T-Mobile has no record of the charge, you didn’t receive a post card or didn’t pay in full the $200 ETF.

TCA Staff Tidbit: Yet one more flat rate ETF is thrown to the curb. Hooray! This is also an innovator on the technical side. It’s great to see class action lawsuit settlements continue to improve technically. This is the first big settlement (with millions of potential claimants) where you could file your claim online AND attach scanned pictures of your supporting documentation so they’re included in your submission (without requiring you to send them in to an email address or via paper mail.) That’s a big step up and really helps increase the claim rate dramatically. This particular settlement helps more people than the a few previous ETF settlements (Sprint Nextel and Verizon to be exact) since they’re allowing those who were charged an ETF and chose not to pay it to make a claim. In the previous ETF settlements those folks were left out. They won’t get the mark erased from their credit report or the full $125, but, some is better than none, right? $25 is $25 and that’ll pay for a nice dinner and even a cocktail at your neighborhood tavern (even in New York City!) For those who can claim the full amount, $125, make sure to do so! That’s a great settlement (in our opinion!)

 

It will be interesting to see if this one is challenged. As you well know if you follow Top Class Actions that tends to happen with large settlements. I think you’ll see the valid challenges decrease in these ETF settlements as the platiiff attorneys working these cases continue to adapt their settlement agreements to conform with the outcomes and address the challenges which have been raised in the previous ETF class action cases.
