Details: The LA Fitness settlement will resolve a class action lawsuit (Vaughn v. L.A. Fitness International, LLC) that claims LA Fitness breached its Monthly Dues contract and violated the Florida Deceptive and Unfair Trade Practices Act by representing that its membership agreement was a “monthly” contract that could be terminated (along with monthly dues billing) simply by following the contract’s cancellation procedures. However, LA Fitness made it virtually impossible to cancel the contract without being charged at least one or two months of additional dues, even member followed the contract’s cancellation procedures, according to the class action lawsuit.
The class action lawsuit charges LA Fitness with using unfair, confusing or misleading language in its contracts, and also challenges the terms, policies and contract forms used for the Monthly Dues Membership. The lawsuit claims that, as a result of these breaches and violations, Class Members were damaged.
LA Fitness denies the allegations, but has agreed to a class action lawsuit settlement to resolve the litigation.
Class Members of the LA Fitness class action settlement include all individuals who cancelled their Monthly Dues Membership Agreement with LA Fitness during the Class Period of May 18, 2006 to January 1, 2013. Excluded from this Class are persons who entered into monthly contracts in California or New Jersey. (New Jersey customers will be eligible to file claims under a separate class action lawsuit settlement agreement that has not yet been publicized. Keep checking Top Class Actions for details.)
Under the settlement agreement, LA Fitness has agreed to provide all Class Members a fully transferable 45-Day Club Access Pass, which has a monetary value of $45. Class Members will also be able to claim a cash refund of all or some of the dues they paid after cancelling their contract, depending on which subclass they fall under.
The only way to receive a cash payment from the LA Fitness class action settlement is to submit a valid Claim Form by August 9, 2013.

LA fitness did the same to me and i did not get a notification of a class action. What happens now?
I tried to cancel they threaten me I was able to cancel my PT trainer only after I was injured an had a doctors note ……………I want my money back from my membership an PT ……..thanks stacy
