Apple class action lawsuitA federal judge has preliminarily approved a $53 million class action settlement between Apple Inc. and thousands of iPod Touch and iPhone users who say they were denied warranty coverage because Apple stated their devices had been damaged by liquid. If you were denied warranty coverage for your iPhone (on or before December 31, 2009)or iPod Touch (on or before June 30, 2010), you may be eligible to claim up to $215 from the class action lawsuit settlement.

The Apple warranty settlement resolves multiple class action lawsuits (consolidated as In re Apple iPhone/iPod Warranty Litigation) that allege Apple wrongfully denied warranty coverage by stating that customers’ iPhones and iPod Touches had been damaged by liquid because a Liquid Contact Indicator (“LCI”) or Liquid Submersion Indicator (“LSI”) visible through the headphone jack or dock connector had turned pink or red. Plaintiffs contend the company that makes the LCI tape admitted that humidity — not water contact — could cause the color to turn pink, if not red.

Apple denies any wrongdoing but has agreed to establish a $53 million class action settlement fund to compensate Class Members and resolve the costly litigation.

Class Members will receive a proportionate share of the Apple warranty settlement, which will be determined by the type (i.e., iPhone, iPhone 3G, iPhone 3GS, iPod touch) and configuration (i.e., 4, 8, 16, 32 or 64 gigabytes) of the device for which they sought warranty coverage from Apple.

The average cash award you may receive from the Apple warranty class action lawsuit settlement will be:

To qualify for a cash payment, Apple must have denied warranty coverage:

  • for your iPhone on or before December 31, 2009, OR
  • for your iPod Touch on or before June 30, 2010.

Some Settlement Class Members, called “Direct-Payment Settlement Class Members,” will receive a cash payment even if they do not submit a Claim Form. If the Settlement Administrator has all the information necessary to process your cash payment under the settlement, you will be sent a customized notice (by postal mail or email) advising you that you are a Direct-Payment Settlement Class Member. However, if you are a Direct-Payment Settlement Class Member you will receive a check only if the Settlement Administrator’s records reflect your current mailing address, so you should check to ensure that the notice you receive reflects your correct mailing address. If it does not, you must provide or correct it. You can provide or correct your U.S. mail or email address by clicking here. The deadline for providing or correcting your mailing address is October 21, 2013. If your mailing address changes after the deadline, you must notify the Settlement Administrator within 45 days after the change at the website above.

If you are not a Direct-Payment Settlement Class Member, you must fill out and submit a valid Claim Form online no later than 9:00 p.m. Pacific time on October 21, 2013 or by mail postmarked no later than October 21, 2013 in order to receive a cash payment.

    will there be one for their laptops? there is a flaw in the design of the item based on water damage. They do not warn you in store of this , they don’t warn you of repair charges, nor do they offer a plan to protect you…they don’t even dsuggest a plan.

    I tried filling out the claim form 10 times online and I keep getting a message ‘Invalid E-mail Address’. There’s definitely a glitch in this Claim Form.

    I had such a problem, I moved and left the phone there. It would power up and flick right back off sometime. The phone had a mine of its own.

    Should have been through December 2011. iPod was less than a year old when the main power button broke and they said they couldn’t fix it because of water damage. Bullshit. The mark was just barely pink and I know I didn’t get water on it.

    TRIED TO SUBMIT A CLAIM AND IT WOULD NOT GO THROUGH. i WAS DNIEDA CLAIM ON MY IPHONE THAT WAS UNDER APPLECARE WARRANTY TEOLD ME THAT I DROPPED IT IN TOILET! REDICULOUS!
    I PAID FOR MY WARRANTY UP FRONT AND THEY DENIED MY CLAIM AND WANTED TO CHARGE ME ANOTHER $250 TO FIX IT CUZ THEY SAID IT WAS MOISTURE DAMAGE.

    I have an iPod 3G 16 GB that froze up and wouldn’t reset…they told me it was due to water damage and I told them there was no way. I didn’t understand why they would tell me something that wasn’t true. Is like to be included in this.

    The APPLE one isn’t letting us sign in under B. It is overlaying teh check box required. Teh deadline musts be extended because of this.
