11/1/08 UPDATE! This settlement is being CHALLENGED by Plaintiff attorneys! If you missed the deadline, join the email newsletter list! We'll notify subscribers if/when they reopen it! The feeling in the class action world is that this settlement was processed entirely too quickly and far too many class members (current and former Verizon customers who paid an Early Termination Fee) were unable to sign up and take part in the settlement. Details: Head to the claims administrator website. Click on the "File a Claim" option on the left. The website walks you through the process. If you've already received a card in the mail with your claimant number, make sure to fill it in. If you haven't received the card in the mail that's OK. Continue with the process and fill out the information to the best of your ability. MAKE SURE TO PRINT OUT A COPY OF YOUR COMPLETED CLAIM FORM! Keep in mind that unless you are sending in proof of your claim, you don't have to submit a paper claim. If you are worried about getting paid the full amount of your claim our opinion is that you should send in a paper copy of your claim, along with the proof to the address above. If you don't do that, and Verizon Wireless can't "locate" your ETF charge they will likely only give you the default amount of $25. We (and I'm sure you) don't want to see that happen. If you've moved, or canceled your service and were billed the ETF at a previous address, again, in our opinion, your best bet is to send in the paper claim with the proof of the claim (if you have it.) That's it! With the settlement going before the judge on October 24th, there's a SLIM chance you'll get a check in time to go towards your Chirstmas / Hanaukka / Kwanzaa credit card card bill you receive in January. It's more likely the check won't arrive until close to the middle of next year, but, you never know!

Purchased From: July 23, 1999 - August 10, 2008

Claims Accepted Until (YOU MUST SUBMIT YOUR CLAIM BY THIS DATE!): October 14, 2008

Class Action Lawsuit Settlement Amount(s): $21,000,000 - $7,350,000 in attorney fees - all expenses related to paying out the suit (advertising the notice, settlement administrator expenses, etc.)

TCA Staff Tidbit: Hooray! Verizon Wireless settled the ETF class action lawsuit in California and extended the settlement to cover the entire U.S. If you were charged an ETF by Verizon Wireless between July 23rd, 1999 and August 10th, 2008 than you should submit a claim.VERY SIMPLE! What are some of the interesting points of this settlement? First, if Verizon Wireless can't locate the proof that they charged you an ETF (keep in mind that this is going back to 1999 so the records may be a little sketchy) then they will STILL give you $25 (or less if the settlement fund is almost tapped out but NOT less then $5.) Yay. That's pretty cool in our opinion. No, not the $5 part, the part about no proof of the charge still netting you up to $25. All you have to do is file the electronic claim, put in your info, and you'll get a check for $25 (or whatever is left in the settlement fund.) THAT'S cool. So, head over to the Settlement Administrator website and stake your claim. I did, shouldn't you?

Would like to take part in this. I feel like a hostage in order to get out I have to pay and PAY and PAY. In any other business this would be unacceptable. Can you imagine your electric company (bad example monopoly is still far to common maybe we can change that with the many other available energy sources that will be developed and made available to the public that could volley the monopolized way that has played in the  ruining of our economy.
ALTHOUGH I FAILED TO GET KNOWLEDGE OF THE SUIT IN TIME ENOUGH TO TAKE ADVANTAGE OF MY RIGHT AS A CONSUMER, I AM STILL INTERESTED IN KNOWING WHAT THE COURT'S DECISION IS REGARDING THE CONSTITUTIONALITY OF ETF.  I AM RUINING MY CREDIT RATING BECAUSE I AM STRUGGLING PAYING V W Z BILLS FOR MY HUBBIES CELL, MY CELL, AND A BROADBAND CONNECTION WHICH ARE ALL LINKED TO ONE ANOTHER.  IT WOULD COST ME $175.00MULTIPLIED BY 3  IN ETF TO END MY SUBCRIPTION WITH THEM.  EACH SERVICE ADDED STARTED MY TWO YEAR DATE OVER.  I WOULD LIKE TO END THIS MADNESS, BUT I CANT AFFORD THE ETF.  HELP ME BY LETTING ME KNOW IN BRIEF WHAT THE COURTS DECIDED.  THANK YOU VERY VERY MUCH!

Annie,

We're sorry to see that you missed out on registering for this settlement. Please note, we aren't the settlement administrator who sent out your post card. If you want to contact them you can do so at the phone number listed above or go directly to the Settlement Administrator website. Please subscribe to our newsletter (always free!) so you don't miss out on another claim like this one.

Thanks for coming to Top Class Actions!

Just received the post card in my P.O. Box this week. It would have  been nice if you all could have sent the claim form without us having to go the website for it.  I really needed to take advantage of this opportunity because Verizon charged me an early termination fee because they cancelled me while I was still making payments on my account.  My payments were not enough they said and I had been a customer with Verizon for over 10 years and subscribed to three lines with them.

This process should have been handled a little better.  Thanks

Top Class Actions Staff

Richard,

Top Class Actions is unable to send claim forms to those who request them. Those who need claim forms need to go to the settlement administrator website and fill them out and print them there. I apologize that you're having difficulty doing so. If you are unable to go to the Settlement Administrator website I would recommend calling them and seeing if they can send you a form in the mail. For the Verizon case, the settlement administrator doesn't have a phone number listed. You'll want to email them at \n This e-mail address is being protected from spambots. You need JavaScript enabled to view it . If you aren't able to contact them, you can also try going to their websites. The contact form for Coughlin Stoia Gellar Rudman Robbins is:

https://www.csgrr.com/csgrr-cgi-bin/mil?templ=contact/request-info.html

and the other firm representing the class is Bramson, Plutzik, Mahler & Birkhaeuser and their contact info is here:

Tel (925) 945-0200

I hope this helps! Keep in mind, that the claim form has to be postmarked by October 14th, so you still have the opportunity to head to a Kinko's to print out the claim form or ask a friend or neighbor to print it out for you.

Good luck! I hope you are able to make your claim!

  1. I received a postcard about this lawsuit last year & submitted all the supporting documents. I included copies of my invoices from Verizon & a copy of my cancelled check proving payment of the ECF. I never received any further information, including any refund as part of this settlement. It seems I was just being used to support the lawsuit for documentation, not for my own personal benefit. Very disappointing.
  2. I filed when I received notification regarding this lawsuit because I did pay early termination fees. I have not heard anything from my submission of the required paper work. I did, however move from Milwaukee, WI to Denver Colorado. Please make note of my new address. 8390 n sheridan blvd Arvada, CO 80003 #204 414 688-8218. I look forward to hearing from you. Thank you.
  3. I haven't paid an ETF but have been threatened with one for each of two lines I want to remove from my friends and family account. I'm going to cancel the two lines and not pay the ETF unless that would make more trouble for me than the $350. Because ETF's have been deemed illegal, can I be penalized other than getting a black mark on my credit rating?

  4. Hello, I'm still waiting for the ETF. Have the checks been mailed?
    Thank you,

  5. It's been so long, I forgot about this. I was reminded when I recently got a copy of my Credit Report and enven though I paid Verizon for ETFs on three phones ($525.00) I still have a bad mark on my credit report. I couldn't pay them all at once so it was spread out over a time. But it got paid. I did send in the card and paperwork for the class action lawsuit, but have never heard anything more. What happened? Did anybody get reimbersed?
