Subway Employee Class Action Lawsuit
By Kimberly Mirando
The Subway employee class action lawsuit accuses the company of improperly denying its sandwich artists rest breaks and requiring them to work off the clock in order to reduce payroll hours. The class action lawsuit also charges the Subway franchise with the following wage and labor violations:
– paying employees less than the minimum wage;
– failing to pay overtime wages when due;
– failing to pay wages without condition;
– forcing employees to come in on scheduled day off without paying a minimum two hours pay;
– failing to post applicable Wage Orders;
– forcing employees to work seven consecutive days without overtime compensation;
– failing to provide employees with accurate itemized paystubs; and
– failing to provide employees with a copy of documents contained in their employment file.
The subway employee class action lawsuit is brought on behalf of all current and former Subway non-managerial employees of Subway franchises owned and operated by By Faith, Inc. at any time within the past four years.
It is seeking unpaid minimum wages, unpaid overtime wages, missed rest period premium payments, improper wage statement penalties, waiting time penalties, costs, interest and attorney’s fees.

I worked for subway for almost 8 years just quit one week ago everything was good fir six years until my manager past away everything changed since then we had many new managers and DM’s and yes some of the new managers didn’t wanted to hire black people or people that doesn’t speak spanish do to the fact that one of the msnagers didnt speak english. I had a big big online order almost 700 dlls order i had only 1 and a half our to make it i had no help at all between customers and online orders so the customer canceled the order then finaly my DM answered my messages telling me i had more thsn enough time to make the order. That is impossible so i quit i closed the store i know I didn’t do the correct thing but things were getting out of control i was very frustrated every morning i had to do the nights shift because they were not doing there job i have proof of that I used to love my job until thing got bad at my store bad management its the problem
I was forced to work off the clock, my hours were constantly edited, once I spoke up I was let go. This company needs to be stopped I worked for 20 hours a week off the clock, sometimes MORE for 3 consecutive years!!
I was sexually harassed, touched inappropriately comment constantly degraded by both my pervert boss and my coworkers. When I complain to upper management they retaliated by reducing my hours. Between the sexual harassment and the hours that they reduced me to I was forced to quit. From what other employees tell me my boss is famous for touching women inappropriately and then retaliating by reducing their hours when they speak up
I know of a franchisee that has been giving jour NSF checks to his employees for the past three years . this owner has over 50 units .
And to get paid is like act of congress.
I know of over 100 plus employees that deals with this weekly .
And sad thing Subway Corp knows about these issues . So I would say the next class act should be too the company .
I ment I am NOW working at a subway……and I meat PART OWNER not Parr
I am not working at a subway… The man who is Parr owner is SO RUDE TO HIS employees ….. We can NOT break unless we are informed to do so…. If every thing is cleaned and everything is prepped we STILL CAN NOT SIT …. Every day we come to work he has an attitude (VERY RUDE) even in front of the customers…. All he wanna do is GET DRUNK on the job (YES THE OWNER) if he don’t have his drink his attitude becomes off the meter…its only 6 of us working there we all are part time….meaning 18 hours or LESS….. I just would like to be treated as a employee NOT A DOG…..is there ANY action I can take to improve this?
Same with the Subway in Monroe, Ohio. treats his employees like dirt, falsely accused employees of stealing just to get rid of them, don’t pay their last checks, no breaks, there’s a list. and all the while he’s been committing income tax fraud. there have been truly committed employees that gave there all, and then some to be treated so bad It’s a shame, they can’t even cash there checks it will bounce. I’m sure the Labor board by now has to be on to him, there has been so many he screwed.
i don’t know about you but my franchise owner treats me like i am a pile of crap and today he told me i was and everyday he tells me i am not slow and i am not quick enough to get my crap done in time but, i am his asst. manager and i know from his wife that he hates it that i stand up for myself and i talk back to him because he’s from india and he’s use to indian woman just taking his crap and i refuse to do it.
