Roto-Rooter Service Technician Class Action Settlement

Roto-Rooter service technicians have won preliminary approval of a class action lawsuit settlement concerning unpaid overtime and other wages.
The Roto-Rooter settlement will resolve a class action lawsuit, entitled Rodriguez v. Roto-Rooter Corporation and Russell Warner, Inc., alleging that Roto-Rooter failed to pay all wages owed to its California service technicians, including regular wages, waiting time, on-call time, warranty inspection time, reporting time, overtime wages, and payment of all wages timely when earned and when employment ended. The class action lawsuit also claimed Roto-Rooter failed to furnish accurate itemized wage statements during the class period.
Roto-Rooter denies it did anything wrong, but has agreed to furnish about $460,000 to pay claims by California service technicians who were employed with Roto-Rooter during any week from September 21, 2006 until March 15, 2012. The amount of money you can receive from the Roto-Rooter wage class action settlement will depend on the number of people who file valid claims, as well as the number of weeks you worked during the class period.
To receive any payment from the Roto-Rooter service technician class action settlement, your claim form must be received no later than May 24, 2012. If you have not received a Class Action Settlement Notice and claim form for the Roto-Rooter settlement, you can request one by calling the Class Administrator at (888) 468-0296.
