Unum Reverses Benefit Denial for Woman with Anal Cancer

disability insurance appealUnum has been at it again – denying yet another legitimate disability benefit claim. This time Unum’s benefit denial was for a woman who cannot control her own bowel movements, which the company evidently felt should be something she could work through. However, after consulting a Unum fraud attorney, this shameful denial was reversed.

Details of this Unum Benefit Denial and Appeal

The woman at issue in this benefit denial was suffering from a severe condition called Invasive Squamous Cell Carcinoma of the Anal Canal, which caused her to be unable to control her bowel movements. Prior to the Unum policyholder retaining an attorney, Unum evidently did not feel that her symptoms of frequent and chronic bowel movements, anxiety, rectal pain, and depression were enough to warrant approval of her disability claim.


The Unum policyholder, who previously worked as a CFO/VP of Finance and Administration, was previously diagnosed with anal cancer. From there she received radiation which then caused her to suffer from the bowel incontinence. It was reported that the Unum policyholder suffered from accidents around 3-4 times per week. The woman’s doctor agreed with the fact that she was not in any condition to work because of the diarrhea she persistently experienced as well  as the that fact that she was unable to control her bowel movements. This information was provided to Unum prior to the initial benefit denial.  However, they ignored this information and denied the benefit claim anyway.

Unum’s position on the benefit denial was that the policyholder was completely capable of continuing her work as long as there was a bathroom within 100 feet of her. However, Unum’s solution still did not prevent her from having accidents, and the care she required each time she had an accident was not feasible for the office environment, including showering to clean herself and washing her clothes. Also, these situations would cause the Unum policyholder a great deal of stress and anxiety.

Finally, the woman was forced to retain a Unum benefit denial attorney to file an appeal on her behalf. Her lawyer made a strong case against Unum’s stance — that all she needed was a bathroom within 100 feet — and stated that if any Unum employee were in the same situation they would likely feel differently about their assumption that working with such restrictions was possible.

After the attorney submitted the appeal, Unum reinstated her benefits by determining that she was indeed disabled. She was also paid her past owed benefits.
