Lawsuit Alleges Unum Claim Denial Based on ‘Biased Information’

Unum disability insurance denialOn July 2, Andre Griffin filed a Unum lawsuit, alleging that the insurance company wrongfully denied his legitimate disability claim. Griffin claims that Unum’s decision was based on “biased information” and “flawed expert opinions.”

Griffin was an employee of Banner Management, which provided him with a Unum long-term disability plan. When Griffin suffered from a disability that prevented him from working, he filed a claim seeking Unum long-term disability benefits. When Unum initially denied his claim, Griffin appealed the denial and pursued all available administrative remedies without success.

According to Griffin, Unum failed to make a reasoned and principled determination about whether to grant his disability claim. Instead, Unum ignored evidence about Griffin’s disability and operated under a conflict of interest when choosing to deny benefits.

Griffin is seeking long-term benefits under the Employee Retirement Income Security Act (ERISA), a federal law that establishes minimum standards for employee benefit plans and ensures that they are maintained fairly. In his Unum lawsuit, Griffin asks the court to review Unum’s disability claim denial process and order the company to complete a “full and fair” review of his disability claim.

Griffin’s Unum lawsuit is Andre Griffin v. Unum Life Insurance Company of America, Case No. 6:13-cv-01818-TMC, in the U.S. District Court for the District of South Carolina Greenville Division.

Unum Has Been Accused of Using Unfair Disability Claim Denial Tactics

Unum is the largest disability insurance provider in the United States. Millions of people rely on Unum to help them in case they experience an illness or disability that prevents them from working. However, Unum has been targeted by thousands of disgruntled policyholders who claim that the company used unscrupulous business tactics to justify denying their legitimate disability claims.
