Unum Customer Seeks Past, Future Benefits in Disability Insurance Lawsuit

disability insurance lawsuitIn a new lawsuit filed July 9, Kevin Kyarsgaard alleges that Unum Life Insurance Co. of America wrongfully terminated his monthly disability insurance benefits and failed to provide an adequate explanation of why they were terminated and how to revise his claim.

As a former employee of Northrop Grumman, Kyarsgaard was a member of a long-term disability (LTD) insurance plan through Unum provided by the defense contractor. After an injury sustained around December 2009, Kyarsgaard applied for monthly disability benefits. According to the stipulations of his Unum policy, long-term disability benefits are available when a worker is “limited from performing the material and substantial duties of [his] regular occupation” or if he loses 20 percent of his income following an illness or injury, the Unum lawsuit states.

By denying his claim in August 2010, Kyarsgaard’s disability insurance attorney alleges that the company did not adequately review his claim nor did it inform the plaintiff of why he had been denied benefits. The Northrop Grumman employee is seeking damages including payments allegedly owed since June 20, 2010, according to the Unum lawsuit.

In addition, the Unum lawsuit notes that Kyarsgaard is still disabled and should be receiving benefits according to the existing policy rules.

The man’s disability insurance attorney is also seeking to verify whether or not claim denial specialists at the company wrongfully kept him from receiving benefits as part of the case.

The Unum disability insurance lawsuit is Kevin Kyarsgaard v. Unum Life Insurance Company of America, Case No. 13-cv-22435, U.S. District Court, Southern District of Florida.
