Florida Man Wants Unum Disability Insurance Benefits Instated

James Randall of Florida says that he has not received the benefits he deserves as a result of being unable to work, according to a new Unum disability insurance lawsuit filed on July 16 in U.S. District Court in his home state.

The Unum lawsuit notes that Randall initially applied for benefits after becoming disabled around the beginning of 2011. He reportedly ran into problems with claim denial specialists at the benefits provider. After going through the administrative process, the man says he had to hire a disability insurance lawsuit lawyer to fight for the benefits he says he deserves as a member of New York Life Insurance Company’s benefits plan. New York Life Insurance Company is a subsidiary of Unum.

Numerous Unum Lawsuits Allege Claim Denial Wrongdoing

Many Unum lawsuits note that while Unum Life Insurance of America has a fiduciary duty to policy holders to pay them any benefits they are owed, the company may have a conflict of interest because its profits increase any time it can deny a claim. Even if not consciously doing so, company employees may not always follow the procedures required under Unum’s own policy or accurately assess medical records provided by those unable to work.

Along with Unum lawsuit plaintiffs like Randall who have never received benefits they allege they deserve because they are part of plans like those offered by New York Life Insurance Company, others have argued in various lawsuits that they have stopped receiving monthly payments prematurely. In either case, it can be tricky because these cases do not go to a jury trial. The fine print in most contracts requires a hearing in front of an administrative law judge that can be difficult to navigate for some plaintiffs.
