PTSD Sufferer Sues Unum Over Denied Insurance Claim

Unum insurance lawsuitPeggy Powell of Georgia has filed an insurance lawsuit against Unum over a wrongfully denied long-term disability insurance claim.

According to the Unum insurance lawsuit, Powell was employed as a loan officer for Claxton bank, which provided long-term disability insurance to their employees. The Unum Life Insurance Corporation underwrote these insurance policies. During this time, Powell paid into the long-term disability insurance plan. The Unum lawsuit asserts that Powell was a participant under the plan according to the guidelines set by the Employee Retirement Income Security Act or ERISA, which legislates and codifies many types of insurance policies.

In 2012, Powell submitted a disability claim to Unum along with medical documentation of her ailments, which include major depressive disorder, generalized anxiety disorder, Post Traumatic Stress Syndrome or PTSD, and other medical conditions. The evidence Powell provided also included a written opinion of Powell’s psychiatrist.

Despite this documentation, Unum denied Powell’s initial long-term disability insurance claim. Unum’s initial statement held that Powell was not disabled according to the terms of her insurance policy.

Powell says she timely appealed Unum’s decision to deny her long-term disability claim. She sent additional documentation, outlining escalating problems with her psychiatric issues, and providing medical documents, including a Mental Impairment Questionnaire from the treating psychiatrist. As a result of her appeals, Unum sent her a letter dated June 5, 2013, stating that Powell had exhausted all administrative appeals processes with Unum.

The Unum lawsuit holds that the decision to reject her long-term disability claim was “‘arbitrary and capricious’ and is the result of Unum’s disregard of the medical and vocational documentation showing that Powell remained “disabled” under the terms of her Unum insurance plan.

The Unum lawsuit alleges that the claim was wrongfully denied, and Powell is entitled to receive benefits per the long-term disability insurance plan.

The lawsuit seeks to get Unum to pay out the full amount of Powell’s disability insurance claim. This includes the unpaid and accrued benefits to date. The lawsuit also seeks to make certain that Unum continues to pay out the benefits from this point forward.

The case is Peggy Powell v. Unum Life Insurance Company of America, in the U.S. District Court for the Southern District of Georgia, Statesboro Division.

    Hi,

    I was cheated out by met life for 140k. Why isn’t anyone suing them? I’ve requested several attorneys and I know met life has a process of getting people to settle for practically nothing. They cut the disability off w/o the person being examined by a doctor, they use their own rules that they change when they want to, if a person is lucky enough to get anything out of met life, the arbitrator tells people, that someone w/a six figure income sued in court and met life won. Why can’t something be done before I die? I’m living below poverty because they stole my disability w/o doing a due process of review.

    I Was deniend too an my daughter has Seizures, Biopolar, an Stress Disorder. Thank God for Lawsuits.
