Unum Hit with Another Lawsuit for Cancelling Benefits

Unum LawsuitMarie Jean thought she was covered when it came to long-term disability (LTD) insurance. She had Unum, one of the largest providers of LTD in the U.S. However, what she didn’t realize is that Unum has been the target of numerous complaints regarding wrongful denials and terminations. Jean is now one of many who has been forced to sue Unum to get the benefits she says she is owed.

There have been prime time exposés on the way Unum allegedly does business, with (now former) employees revealing a documented bonus system rewarding employees for denying or canceling Unum disability claims. However, the company remains one of the most often-used LTD providers in the country, with employers particularly opting for group policies. 


Jean filed her Unum lawsuit on August 28, 2013, after exhausting all other resources for getting the disability compensation she says she deserves. The Florida woman is filing for breach of contract, claiming that she satisfied all requirements of the company and qualifies as permanently disabled — but yet she still hasn’t received all her due compensation.

The Unum Lawsuit Allegations

Jean claims in her Unum lawsuit that she’s “disabled as the term is defined in the policy, and is entitled to disability insurance benefits by virtue of the disability.” 

People who are filing disability claims are already going through enough. Depending on the severity of the disability, they may be simultaneously undergoing rehabilitation, facing big medical bills, loss of income and basically re-learning how to live with these new circumstances. Some Unum claim denial victims claim that the company preys on these people who are going through tough times, perhaps hoping that they will just “give up” and stop fighting. The number of people filing Unum lawsuits is indicative of how often claims are denied or payments suddenly terminated.

Jean claims she’s tried everything in her power to get Unum to act lawfully. However, her lawsuit says that everything she’s done to satisfy the requirements have been “waived, excused, estopped, tolled, rendered moot, rendered a vain act, or otherwise rendered unnecessary” by Unum. Suing Unum is her last resort. 

She says Unum has “disregarded favorable evidence submitted by (Jean),” leaving her with only a Unum lawsuit as her means to getting her due compensation. 

According to her lawsuit, Jean “suffers from disabling chronic dyspnea with angina, shortness of breath, pulmonary nodules with hypoxia, arthritis, radiculopathy, myalgia, hypertension, GERD, cardiomegaly with mitral valve prolapse, and other disabling medical conditions.” She claims she’s “totally disabled” given that that’s also her doctor’s diagnosis, but Unum says she’s not disabled at all. 

“Because of the defendant’s refusal to pay benefits due (Jean) under the policy, (she) has been forced to retain undersigned counsel to prosecute this action and has become obligated to pay a reasonable attorney’s fee, and has incurred necessary costs of prosecuting this action,” the Unum lawsuit says.

Making a Tough Situation Worse

It’s challenging enough to be deemed totally disabled, but some Unum policyholders like Jean feel like the rug has been pulled out from underneath them completely. Their LTD coverage is supposed to be their safety net when the worst happens. Jean is suing Unum for damages for past, present and ongoing disability benefits, interest on the claim, attorney’s fees, court costs, ancillary benefits, and any other relief the court sees as appropriate.

The case is Marie Jean v. Unum Life Insurance Company of America, Case No. 6:13-cv-1328-ORL-22DAB, The United States District Middle District of Florida Orlando Division.
