Unpaid Overtime Leads to Wage & Hour Lawsuits By Christina Drury Throughout the years, complaints against employers for improper payment methods have increased. Many workers are failing to receive overtime pay or have even been forced to work off the clock to complete work without receiving payment. One such incident that has occurred recently involves a large restaurant chain that is popular in the south, known as Steak ‘n Shake. The two plaintiffs in the unpaid overtime class action lawsuit, Beecher and Cain, are seeking class action status against the employer for several violations of the Fair Labor Standards Act (FLSA). Restaurant Reportedly Changed Tip Amounts Among the chief complaints in the wage and hour class action lawsuit is that the restaurant not only changed the clock-in and clock-out hours on employee time cards, but also inflated the amount of tips that the employees actually received. Class Action Lawsuits Over Unpaid Overtime, Wages Pick Up Steam By Jessica Tyner
Around the country, more employees are taking action when it comes to their unpaid wages and unpaid overtime. "Wage and hour" lawsuits are kick-started when an employer refuses to pay an employee for the real amount of time worked -- including overtime -- or pressures a worker to work off the clock. Oftentimes, an unpaid overtime lawsuit or employment class action lawsuit is the only way to recover wages owed to you. As a result, wage and hour lawsuits have been growing into the hundreds for the past five years.

This has been going on for years, such as the case with "Linda," who was in a serious collision in 1997 that left her disabled. She filed and was approved for Unum disability benefits, but mysteriously in 2002 -- five full years later -- her compensation was revoked with no word from the provider.

Nurses Win 5th Class Action Settlement Over Unpaid Wages in New York By John Curran
Recent lawsuits against many businesses regarding wage and hour violations have mounted in the United States. Many of these lawsuits concern unpaid overtime, as well as those where firms tried to deem employees independent contractors. In New York, nurses recently won a class action lawsuit settlement with Ellis Hospital in Troy for several million dollars regarding alleged wage fixing by hospitals in the area that cause them to be underpaid.

Tanya Mondolo is the latest plaintiff to win her Unum lawsuit, claiming that she was unfairly denied her Unum disability claim. In addition to being granted her denied benefits and back pay, Mondolo was awarded $119,000 in January 2013 for her attorney fees. According to reports, the court found Unum’s actions “culpable” and found that the company acted irrationally when denying Mondolo her claim. She filed her Unum lawsuit under the Employee Retirement Income Security Act (ERISA).

Top Class Actions has been receiving throngs of complaints about Unum Insurance Company from people claiming that Unum irrationally declines valid disability claims -- leaving the policyholders stuck with insurmountable medical debt. The complaints mirror legal action taken against Unum, with dozens of Unum fraud lawsuits being filed each year. Judy from Portland, Oregon, is just one of the many recent Unum claim denial victims.As a nurse for a mobile unit, Judy’s work takes her to a number of different medical clinics and settings. In 2004, she got a staph infection that wasn’t treatable by penicillin from a simple paper cut. Once the infection entered her bloodstream, it spread quickly and caused Judy to spend weeks in the hospital in so much pain that she could barely move. Her critical condition kept her out of work for a year as she went through rehabilitation in an effort to re-learn how to walk. |
