Do you have a fireplace with a Superior or Lennox brand glass-front safety guard? If so, you may be eligible to receive benefits from a class action lawsuit settlement.
The settlement will resolve a class action lawsuit, entitled Keilholtz v. Lennox Hearth Products, that claims Lennox failed to warn consumers that the sealed glass front of gas fireplaces can be dangerous and cause serious burns from contact with the glass. Plaintiffs in the case claim that Lennox concealed the fact that the sealed glass-front surface of certain gas fireplaces can reach temperatures high enough to cause third-degree burns to the skin.
You’re considered a member of the Lennox Hearth Products Settlement Class, and entitled to benefits, if you:
(I) Live in the United States (including California) and own a home or other residential dwelling that you bought for personal, family or household purposes and that home has one or more Superior or Lennox brand single-pane sealed glass front gas fireplace(s) that was installed between February 6, 2004 and January 11, 2011.
(II) Live in California and own a home or other residential dwelling that you bought for personal, family or household purposes and that home has one or more Superior brand single-pane sealed glass front gas fireplace(s) that was installed between March 1, 2003 and February 5, 2004.
You are not a member of the Settlement Class if you suffered a personal injury related to these fireplaces.
As part of the Superior and Lennox fireplace class action settlement, you will be able to file a claim to receive a Protective Screen for the Lennox or Superior fireplace that was installed in your home. The Protective Screen is intended to reduce the risk of burns to the skin by preventing direct contact with the glass front. In addition, the class action settlement will provide supplemental information regarding the safety of your fireplace, as well as a warning sticker to be placed on your fireplace control.
To receive any of these settlement benefits, you must fill out and submit a claim form online or postmarked by August 1, 2011 or 60 days after the Final Approval Hearing, whichever comes later. If you wish to exclude yourself from the class action settlement, you must submit your request no later than May 2, 2011.
Lennox has also set up a website that allows anyone, regardless of whether they’re in the settlement class, to receive a free Safety Guard for their Lennox or Superior single-pane, sealed front gas fireplace (visit the website here).
Claim forms and further instructions on how to file a valid claim to receive benefits from the Superior & Lennox Fireplace Class Action Lawsuit Settlement can be found at www.LennoxHearthClass.com.
