deep vein thrombosisTexas plaintiff Kristen Martinez is suing Merck & Co. for the injuries she allegedly sustained from their birth control product, NuvaRing. Martinez alleges that as a result of using the NuvaRing, she developed deep vein thrombosis and still continues to suffer from the complications.

Martinez first started using the NuvaRing in January 2006. Initially, there were no complications and the product functioned as described. However, in June 2007, the plaintiff started suffering from painful side effects, and was soon diagnosed with deep vein thrombosis. Martinez still suffers from this complication and must undergo regular checkups by her doctor to insure her health.

The plaintiff filed a NuvaRing lawsuit against Merck for her injuries, because information about this side effect had not been available to her at the time she began using the product. Martinez states that Merck and its associates had the responsibility to warn her and other patients of such dangerous side effects. Martinez is suing Merck for manufacturing, selling, distributing and marketing a dangerous product. She is bringing charges of negligence, false advertising, concealing information and misrepresenting a product.

Overview of NuvaRing Complications

Approved for market by the U.S. Food & Drug Administration (FDA) in 2001, the NuvaRing is a plastic vaginal ring that is designed to prevent pregnancy. It is the first vaginal ring approved in the United States, and is currently the only one available in the American market. The NuvaRing is a long-term birth control product, designed to be replaced every month. It is one of the most popular birth control methods, with more than 2 million prescriptions in the United States. Despite its popularity, there have been various reports of complications, indicating that this device may cause health problems in patients.

The NuvaRing is made of a biologically-safe plastic that is designed to be flexible in shape and material to accommodate the shape of the patient’s vagina. The device works by releasing a hormone compound that is composed of ethinyl estradiol and etonogestrel. This hormone is released directly into the bloodstream through the vaginal walls.

Despite the effectiveness of the NuvaRing, the injury reports submitted to the FDA indicate that the hormone compound may be causing significant side effects. In October 2003, a study published in The New England Journal of Medicine observed the side effects of the NuvaRing and other birth control products on patients. The purpose of this study was to determine whether or not the NuvaRing carried the same amount of risk as oral contraceptives. The study found that NuvaRing complications included stroke, heart attack, pulmonary embolism and deep vein thrombosis.

This NuvaRing lawsuit is Kristen Martinez v. Merck & Co., et al., Case No. 0:13-cv-02669-PAM-AJB, in the U.S. District Court for the District of Minnesota.
