Membership Program Debit Card Litigation Settlement

Vertrue, Inc.
Vertrue, Inc. and Adaptive Marketing have reached a class action lawsuit settlement over violating the Electronic Fund Transfer Act (EFTA) for enrolling consumers into membership programs and then charging them monthly fees without the consumers’ prior signed written consent. Anyone who signed on to one of the 50 healthcare, insurance, shopping or family entertainment membership programs listed below is eligible to receive up to $150 per program they enrolled in under the class action settlement. 
Plaintiff Margaret Wike sued the companies in 2006 claiming that Vertrue and Adaptive Marketing used telemarketers to sign consumers up to membership programs and then charged their debit cards for monthly fees without first getting their written approval to make those charges. The case is Wike v. Vertrue, Inc., Case No. 3:06-00204.
You’re considered a class member of the Membership Program Debit Card Litigation if you were enrolled by telemarketing into one or more of the defendents’ membership programs before January 1, 2007 and first received charges for the membership services on your debit card on or after March 14, 2005. The following is a list of membership programs covered by the Membership Program Debit Card Litigation settlement:

If the Court approves the class action lawsuit settlement, Class Members will receive $150 for each valid claim that identifies enrollment in one of these membership programs. To receive your $150 cash award, you must complete and submit a Claim Form postmarked or submitted online no later than December 31, 2011
