Rice Krispies Cereal Class Action Settlement

By Sarah Pierce

Kellogg's Rice Krispies cerealKellogg Company has reached another cereal class action lawsuit settlement over alleged false advertising, this time over the advertising of its Rice Krispies cereal. Anyone who purchased Kellogg’s Rice Krispies or Cocoa Krispies between June 1, 2009 and March 1, 2010 may be able to claim a cash refund of up to $15 from the cereal advertising settlement — no proof of purchase necessary!

The Rice Krispies cereal class action settlement resolves a lawsuit over whether Kellogg Company falsely advertised that Rice Krispies cereal and Cocoa Krispies cereal supported a person’s immunity despite not having competent clinical evidence to support the claim. Kellogg stands by its advertising and denies it did anything wrong, but has agreed to create a $2.5 million settlement fund to pay out Class Members and resolve the litigation. Kellogg Company reached a similar cereal advertising settlement over its Frosted Mini Wheats last year.

You’re considered a Class Member of the Kellogg’s Rice Krispies class action lawsuit settlement if you purchased Kellogg’s Rice Krispies cereal or Cocoa Krispies cereal in the United States between June 1, 2009 and March 1, 2010. Class Members may seek reimbursement of $5 per box of Rice Krispies or Cocoa Krispies purchased, with a maximum receovery of $15 for the purchase of up to three boxes.

To receive payment, claim forms must be completed and either submitted online at www.CerealAdvertisingSettlement.com or postmarked by November 16, 2011. Only one claim form per household. You will not be required to submit proof of purchase; however, you must declare under penalty of perjury that you did purchase the cereal.
