Key Bank iPod Offer Class Action Lawsuit

Key Bank has been hit with a class action lawsuit for reneging on its promise to give people who opened bank accounts a free iPod Touch if they fulfilled certain conditions.
Key Bank reportedly launched its “Free iPod Touch” marketing campaign between 7/12/08 and 8/15/08, wherein it promised to give depositors and those who opened certain Key Bank accounts personal property, such as an iPod Touch, under certain circumstances. The Key Bank class action says that despite completing and satisfying all conditions necessary to receive the promised goods, Key Bank did not deliver the promised property, including iPods.
The Key Bank iPod class action lawsuit is brought on behalf of all depositors who participated in the Key Bank marketing campaign, satisfied the conditions precedent to receiving property from Key Bank, but did not receive the promised item. It is seeking payment of the value of property that each depositor was promised, damages and other relief for Breach of Contract and Unfair, Deceptive and Fraudulent Acts.

The case is Carol-Ann Fuller, et al. v. Key Bank, KeyBank National Association, and Ginger Coulam, Case No. 110904950, Second Judicial District of Weber County, State of Utah.
