 Farmers Insurance Med-Pay/PIP Claims Class Action Settlement

Farmers InsuranceFarmers Insurance has reached a class action lawsuit settlement over allegations it failed to pay expenses for medical services related to automobile accidents under Med-pay and PIP coverage. As a result, anyone who was injured in an automobile accident and submitted a claim to Farmers under Med-pay or PIP coverage — or is a medical provider who was assigned benefits involving Farmers automobile insurance — can receive cash benefits from the class action lawsuit settlement.

 

The Farmers Insurance settlement will resolve a class action lawsuit, called In Re Farmers Med-Pay Litigation, that alleges Farmers failed to pay, in whole or in part, reasonable expenses for necessary medical services under the Med-pay and/or PIP coverages in their automobile Policies. This alleged improper payment was based on Farmers’ use of certain systems and procedures to assist in adjusting claims for payment of Med-pay or PIP Benefits. Farmers denies any wrongdoing but has agreed to the terms of the class action lawsuit settlement to avoid ongoing litigation.

 

Class Members of the Farmers Med-Pay/PIP class action settlement include all U.S. residents who:

* were injured in an automobile accident;

* submitted a claim to Farmers for payment of medical bills under Med-pay or PIP coverage in a Policy;

* had their claim adjusted from January 1, 2001 through February 9, 2009 based upon a recommended reduction from Zurich Services Corporation relating in any way to reasonable expenses for necessary medical services;

* were paid by Farmers or their medical providers were paid by Farmers an amount less than the amount of the submitted medical expenses; and

* were paid an/or their medical providers were paid by Farmers a total, combined amount less than the Med-pay or PIP policy limit stated in the Policy under which the claim was submitted.

 

The Farmers Med-Pay/PIP class action settlement also covers all medical providers and entities who, by written assignment, have the right to assert the claims described above.

 

Under the Farmers Insurance class action lawsuit settlement, Class Members who submit a valid claim form postmarked no later than December 29, 2011 can receive 60% of the difference between the amount of the bills submitted to Farmers for Med-pay and/or PIP claims and the improperly-reduced amount paid by Farmers.
