B2Mobile & LeadClick Text Ad Class Action Settlement
By Mike Holter
A class action lawsuit settlement has been reached with mobile ad company B2Mobile and lead-generation company LeadClick Media over allegations they sent unsolicited text ads to consumers without their prior consent. As a result, anyone who received a text message from the companies within the past three years may be able to receive up to $100 from the text ad class action settlement.
The B2Mobile settlement will resolve a class action lawsuit, entitled Kramer v. B2Mobile, LLC, that claims B2Mobile and LeadClick Media violated the Telephone Consumer Protection Act by sending unsolicited text message advertisements to consumer without their explicit consent. B2Mobile and LeadClick deny any wrongdoing, but have agreed to establish a $12.2 million class action settlement fund to resolve the litigation.
Class Members of the B2Mobile text ad class action settlement include anyone in the U.S. who received a text message that was transmitted by or on behalf of B2Mobile or LeadClick Media without their prior express consent between January 1, 2008 and July 29, 2011. The text messages involved in the class action settlement either came from the shortened phone number “77893” or contained a website link, such as: 1500cashasap.com, offerspotusa.com, myauto411.com, topcash88.com, car499.com, jobsusa411, etc. A complete list of website links is available here at www.TextAdClass.com.
Class Member who file a claim form by March 12, 2012 may be eligible to receive up to $100 from the B2Mobile text ad settlement. The actual amount of payment Class Members will receive, however, will be based on the number of valid claim forms received. If payments are calculated to be less than $5 for each Class Member, the money from the text ad settlement will be donated to charity. The B2Mobile class action settlement also allows Class Members to remove their cell phone numbers from any list or database of numbers to which text messages could be sent on or behalf of B2Mobile and LeadClick.
