M’m! M’m! Settlement! Campbell’s Settles “Low Sodium” Tomato Soup Class Action Lawsuit

Campbell Soup Co. (NASDAQ: CPB) has reached a preliminary class action lawsuit settlement over allegations it misleadingly labeled some of its tomato soup products as having “lower sodium,” even though the sodium content was equal to its regular soups.

The Campbell’s tomato soup class action lawsuit, filed last year in federal court, alleged the company misled consumers into paying more for its “low-sodium” tomato soup, even though it contained as much sodium as Campbell’s regular tomato soup. The Campbell’s soup class action lawsuit also claimed that Campbell’s Healthy Request condensed tomato soup purported to be “Low in Fat,” but contained 1.5 g of fat per serving and 0.5 g saturated fat per serving, more than the regular condensed soup, which contained 0 g fat of fat and saturated fat per serving. [UPDATE: The “Low Fat” claims were alleged in the original class action complaint, but were not included in the Amended Complaint, which is what is being settled.]

 
A federal judge denied Campbell’s motion to dismiss the Campbell’s tomato soup class action lawsuit in March, and granted preliminary approval to the class action settlement in early August.

Campbell’s agreed to provide $1.05 million for the class action settlement fund and an additional $350,000 in attorneys’ fees, pending Court approval at the November 29, 2011 Final Approval Hearing. Class Members – those who purchased Campbell’s “low sodium” tomato soup between July 1, 2009 and August 4, 2011 – can receive up to $10, or $0.50 per can purchased during the Class Period. In addition, the company agreed to follow new labeling procedures to “avoid inconsistent comparisons between the same varieties of reduced sodium condensed and regular condensed soup.”

A final settlement approval hearing is set for November 29. Instructions on how to file a claim for the Campbell soup class action settlement will be made available at least a month before this hearing.
