Rite Aid Price Scam Class Action Lawsuit

Rite AidA federal class action lawsuit against Rite Aid Corporation (NASDAQ: RAD) claims the drugstore chain runs a bait-and-switch scam by changing its shelf tags to reflect a sale price the day before the item actually goes on sale, thereby charging customers full price for an item that is advertised as “on sale.”

According to the Rite Aid class action lawsuit, Rite Aid stores have weekly sales promoting certain items that often include “buy one get one free” sales and “buy one get one half off” sales. These weekly sales typically run on a Sunday to Saturday cycle each week, with the sale items changing with each weekly cycle.

“Even though the weekly sales do not begin until Sunday of each week, it is the policy of Rite Aid to change the shelf tags on Saturday to reflect the sale price (one full day before the item goes on sale). Rite Aid’s cash register then rings up the regular price for the item, even though the shelf tag reflects a sale price,” the Rite Aid price scam class action lawsuit says. Rite Aid’s cash registers eventually begin to recognize the sale price at some point late in the day on Saturday, but only after the shelves have been tagged to reflect the sale price many hours before.

“Plaintiff and Class Members have been harmed by this bait-and-switch style scheme because they were charged full price for items they believed to be on sale pursuant to the shelf tag,” states the lawsuit, which is alleging violation of state Deceptive Trade Practices Acts and Consumer Protection Acts, Fraud and Deceit.  

The Rite Aid price scam class action lawsuit is seeking an injunction requiring Rite Aid to honor the price reflected on the shelf tag, and to cease and desist with the ongoing bait-and-switch style scheme. It is also seeking punitive damages for a proposed nationwide Class of all persons in the U.S. who purchased items at a Rite Aid where an item had a shelf tag reflecting a sale price and the consumer was then charged full price at the cash register for that item.
