UPS Shipping Class Action Settlement

UPSUPS has reached a $12 million class action lawsuit settlement over allegations it overcharged customers for shipping packages. If approved, the proposed UPS settlement will provide account credits or payments to certain customers who shipped packages with UPS over the last five years.
 
The UPS settlement will resolve a class action lawsuit, entitled Barber Auto Sales v. United Parcel Service, Inc., that alleges UPS inaccurately measured the dimensions of customers’ packages, resulting in a higher shipping charge. 
 
UPS allows customers to submit their own package measurements (e.g.; height, length, width and weight) when shipping, but reserves the right in its customer contract to audit package measurements to make sure they are correct, and adjust shipping charges if the customer’s measurements are not correct. According to the UPS class action lawsuit, UPS inaccurately adjusted some package measurements based on its own measurements for some shipments between 2006 and 2011.
 
Class Members of the UPS shipping class action settlement include anyone who shipped packages with UPS between May 15, 2006 and August 29, 2011 and had a shipping charge adjusted upwards as a result of UPS’s audit of package dimensions.
 
UPS denies any wrongdoing but has agreed to set up a $2 million class action settlement fund to pay out account credits or payments to Class Members. The amount of such credits or payments cannot be determined at this time, but will be based on the number of people who file valid claims. UPS has also established a $10 million Compensation Fund for account credit or refunds for future upward adjustments.
 
To receive your account credit or refund under the UPS class action settlement, you must submit a claim form online at www.BarberClassAction.com or postmarked no later than 30 days from the date of the Final Order and Judgment, which will be on or after the Final Approval and Fairness Hearing currently set for December 5, 2011.

    Help! I have a small family owned business with 4 employees and we ship UPS through Amazon. UPS has been doing this for 2 years, 2021 to now (Feb 2, 2023) . They have charged me around $25,000 for additional handling fees that are false. I got a notice today that they “forgot to charge me for last few months and just billed me over $6,000! They normally intentionally “hide” these fees. They provide no notification of this “theft” and deduct it from proceeds. They make it almost impossible to Dispute. I need to file a lawsuit. Can someone contact me?

    UPS will use dimensional weight and if you enter the dimensions of the box and at some point the box gets slightly crushed, the dimensions change. ie you ship 17.3″ x 17.3″ x 17.3″ and one edge gets stepped on, it can easily now be 18″ x 18″ x 17″ and the fees get added. This is made even worse with the lowering of the dimensions for shipping via air and ground a couple years ago.

    It is incredible seeing how little they care about being outlaws. The reps stopped responding to us. With the money they steal from us they grow a rainy fund to keep settling every time they there is a n new settlement. How many times can they settle without going to jail?
    We already switched to USPS for small packages and now working with Fedex and freight for large one.
    What a big saving. Drop UPS people!

    For one year, my company has tried to get the refund that UPS owes. UPS has ignored the requests and been playing run-around tactics.

    So what do we do? Switch to FEDEX and USPS, which by the way are often quicker and less expensive.

    Big Corps with such greed and dishonest practices ALWAYS end up in bankruptcy because they run out of small businesses to rip-off. There is always a choice. My choice is to BOYCOTT UPS and SWITCH TO FEDEX and USPS.
