ASUS Transformer Prime Defect Class Action Lawsuit

UPDATE: A federal judge granted final approval to the ASUS Class Action Settlement on July 15, 2013.

 

A federal class action lawsuit claims ASUSTeK designed its ASUS Transformer Prime tablet with a metallic body that makes its GPS and Wifi capabilities useless.

Lead Plaintiff Colin Fraser says in the class action lawsuit that he ordered an ASUS tablet in December 2011, but before it even arrived he became aware of hardware problems relating to the Transformer Prime’s GPS and Wifi capabilities through forum postings from dissatisfied consumers. The problem was confirmed by ASUS in a December 30, 2011 letter to customers that stated the metallic unibody design of the Transformer Prime blocks GPS and Wifi signals.

“The metallic properties of the design impede the performance of the GPS when the device receives signals from satellites, and was reported to cause the Wifi to become unreliable,” Fraser says in the ASUS computer class action lawsuit.

Fraser says ASUS is aware of this defect, and even acknowledged these problems and apologized for them in a Facebook post.

However, instead of trying to fix the problem, the company’s solution was to remove any references to GPS in the Transformer Prime’s specifications and marketing communications. ASUS’s authorized retailers, however, still continue to advertise the Transformer Prime with GPS capability, the class action lawsuit states.

“As a result of the Defect in the Transformer Prime, Plaintiff and the Class have suffered damages, in that they purchased and/or own a Transformer Prime that they would not otherwise have bought and/or owned had they known of the Defect which can not be remedied,” the ASUS Transformer Prime class action lawsuit states.

“Defendants knew or should have known that the Transformer Prime was defective in design and/or manufacture, was not fit for its ordinary and intended use, and did not perform in accordance with the advertisements, marketing materials and warranties disseminated by Defendants. In addition, Defendants knew or should have know that the Transformer Prime does not conform with the reasonable expectations of ordinary consumers,” the class action lawsuit continues.

The ASUS Transformer Prime class action lawsuit is brought on behalf of all persons in the United States who have purchased an ASUS Transformer Prime tablet. It is seeking injunctive relief, compensatory damages, statutory damages, and all other forms of monetary and non-monetary relief recoverable under state law.

    Not only is the GPS bad, the wifi is weak, The cord connection is flimsy and doesn’t work now. (have to send it in for service). The GPS dongle does absolutely nothing and doesn’t make sense since you can’t use AC or keyboard with it. If Asus does not replace it, it will be my last device I’ll ever buy from them.
