Hotels.com Price Match Guarantee Class Action Lawsuit

A class action lawsuit says Hotels.com does not back up its promise to refund money if hotel guests can find a better rate online, and instead sets an “arbitrary and undisclosed limit” on refunds.
Hotels.com promises customers: “after you book with Hotels.com, if you find a lower publicly available rate on line for the same dates, hotel, and room category, we will march the price and refund you the difference.”
Plaintiff Kaylen Silverberg claims, however, that Hotels.com does not honor its promise.
Silverberg claims in the Hotels.com class action lawsuit that she booked a room through Hotels.com for two nights in Rancho Palos Verdes, California, for $355 per night, then found a $223 per night rate at HotelClub.com. A third website advertised an even lower rate of $213, she says.
Silverberg alleges in the Hotels.com class action lawsuit that when she asked Hotels.com to back up its guarantee, she was told it would refund her only $71 a night, which substantially falls short of the price difference. 
The class action lawsuit says Hotels.com does not back up its promise, and instead “has an arbitrary and undisclosed policy to refund only a portion of the difference between its rate and other, lower rates.”

The Hotels.com class action lawsuit is brought on behalf of all Hotels.com users who, within the past four years, requested, but did not receive, a Price Match Guarantee equal to the difference between (1) the full rate paid to Hotels.com, and (2) a lower publicly available rate online for the same dates, hotel and room category. It is seeking restitution and damages for breach of contract and unjust enrichment.
