Lowe’s Drywall Class Action Settlement Update

Lowe'sTop Class Actions has an exclusive update on the Lowe’s Drywall Class Action Settlement reached in July 2010.

The last time we reported on the Lowe’s Drywall Settlement was in October 2010, when we provided readers with details on how to file a claim. Consumers who purchased or installed defective drywall from Lowe’s before July 27, 2010 had until July 15, 2011 to file a claim to receive between $50 and $4,500 from the class action settlement. Since then, no new information about the settlement has been provided on the settlement website, www.drywallsettlement.info.

Yesterday, we spoke with Class Counsel attorney Patrick W. Pendley of the law firm Pendley, Baudin & Coffin. The good news is that the Lowe’s Drywall Class Action Settlement has been approved by Superior Court Judge Bobby Peters. However, two appeals have been filed that must be cleared before the settlement can be finalized and benefits distributed to Class Members.

Pendley says he is hopeful that the appeals will be dismissed and that the class action settlement will go forward.

“Judge Peters wrote a lengthy opinion approving the settlement, so I have no doubt it will go forward. Had it not been appealed, we would have been well under way,” said Pendley.

    According to the settlement administrator I am to receive a $250 gift card (which I completely don’t understand as my claim was worth MUCH more). To date I have not received my gift card. I have made numerous attempts to find out the status of my card with both the settlement administrator AND the attorney who are supposed to be representing all class members (like me). The attorneys refuse to respond and instead forward my inquiries to the settlement administrator. The administrator initially responded thanking me for my patience (in December of 2012) and since January of 2013 my repeated attempted to find out the status of my gift card have gone ignored and I can’t get a response from ANYONE. This is ridiculous! I don’t want to file a bar complaint against the counsel who is SUPPOSED to be representing all class members but at this point I don’t know what else I am supposed to do!

    I filed a appeal to the decision of only a $250.00 gift card months ago. Every time I call to inquire I get the run around. It would be nice to know a decision. I still have the card, but have not used it. I have repairs that need to be done, and cannot afford to do it. Every stitch of dry wall would have to be replaced in my home. Would just like to know what is going on.

    I sent in medical documentation (certified) along with my claim form. I received a $250 gift card but no cash settlement. I called the toll free number and was informed that no records were received. I questioned the representative regarding receiving the claim form which was in the same certified envelope as the records. I was asked for my name and claim# and told that the information would be forwarded to the attorney. this was 3 months ago, I have not been contacted since.

    Just called this number and gave them my new address. They will start processing returned (due to change of address) gift cards in November of 2012.

    I am equally concerned about the professionalism from those in charge of this class action. I have searched and this is the first update I have seen. The website actually went off-line after the settlement date. I guess nothing to do but watch and wait. For those needing to contact the firm, I had this :call the toll-free number, 1-877-497-3512.
