JC Penney Jewelry Class Action Lawsuit

JC PenneyA federal class action lawsuit claims JC Penney has falsely advertised hundreds of items of jewelry it sells, including diamonds, over a period of multiple years.
 
“JC Penney engaged in a pattern and practice of deceiving consumers through false advertising about the true characteristics of the jewelry it sells via catalogs, in stores, and via the Internet,” the JC Penney jewelry class action lawsuit states.
 
Specifically, JC Penney is accused of:
 
— failing to disclose the use of less-desirable metals, such as rhodium, as plating or finishes over precious metals;
— failing to properly identify the country of origin;
— failing to properly disclose the size of diamonds in its jewelry;
— misrepresenting the number of diamonds in its jewelry;
— failing to disclose the use of alternative, cheaper, less-desirable, or non-precious metals or metal alloys, such as hollow or rolled gold; and
— otherwise failing to comply with the FTC Guides for the Jewelry Industry. 
 
The JC Penney jewelry class action lawsuit is seeking damages and equitable relief for a proposed class of all JC Penney jewelry customers in California who were deceived into purchasing jewelry that was falsely advertised, marketed or promoted during the past four years.

The case is Maria Torres, et al. v. JC Penney Corporation, Inc. and JC Penney Company, Inc., Case No. 12-cv-1105, U.S. District Court, Northern District of California, San Francisco Division.

      I have thousands of dollars invested in JCPenney fine jewelry including wedding rings engagement rings promise rings earring and necklaces and I have kept my receipts along with lifetime warranties It’s traumatizing to see the look on my wife’s face when we found out they are plated and I could see her questioning if I did this on purpose it kills me inside not to mention financially that a big cooperate department store that not only I but my parents and their parents shopped at would betray us in this way for gains of funds we truly are hurt and will never forget it and anytime a chance comes up to tell friends or acquaintances of their dysfunctional disgusting scheme to keep their doors open preying on the American families and people who think they are getting a deal when in reality we were being scammed and they are getting away with it and nobody dares do anything

    I want to be included in lawsuit towards jcpenny . I went to sell my 10k gold necklace and they told me it is fake. I purchased this necklace last year . It’s not right!

    I bought a 10k yellow gold 22″ figaro necklace from jc penny. It was over a thousand dollars. To my disbelief it sticks to a magnet. Gold sold in the USA is not supposed to have magnetic filler metals. If I were to go to sell this necklace I wouldnt be able to and be told that it is not real gold due to its magnetic characteristics. I got ripped off by what i thought was a reputable retailer. What cab i do?

      Food for thought is 10k is only 41.7% gold the rest is fillers and alloys so it would infact stick to a magnet as would anything less than 24 k and even 24k jewelry can because of hardners the gold is to soft without.just food for thought take to a bullion shop and get tested.

    Now I am aware that the stone in the diamond rings are of the lowest quality, although the price can be very high. The bands of the jewelry from this company are so weak a two or three month old infant can bend it.
