Emerson RIGID Wet/Dry Vacuum Class Action Lawsuit

According to the Emerson RIGID vacuum class action lawsuit, “Defendant’s Product is a wet/dry vacuum designed to remove solid debris and liquids from various surfaces through the use of suction generated by an electric motor. Because these wet/dry vacuums are designed to lift materials heavier than that of a conventional household vacuum, the power of the wet/dry vacuum is an important characteristic to consumers.”
Each model of the RIGID wet/dry vacuum contains different horsepower representations, but they are all materially overstated when measured or calculated through “generally acceptable scientific methods and equations,” the class action lawsuit says.
“In addition, Defendant charges a premium for models of the Product that Defendant represents produce more HP than other models that cost less. However,” these higher priced models “are not capable of, or are not reasonably capable of attaining, the increased HP represented by Defendant on the Product and its packaging as compared to other lower priced models,” the Emerson RIGID vacuum class action lawsuit states.
The RIGID wet/dry vacuum class action lawsuit is brought on behalf of all Missouri citizens who purchased an Emerson RIGID brand wet/dry vacuum. It is seeking actual, compensatory, consequential and/or incidental damages; restitution, and more.

The case is Chad Venhaus v. Emerson Electric Company, Case No. 1222-CCO-1476, Circuit Court for the City of St. Louis, State of Missouri.
