Second iPhone 4S Siri Class Action Lawsuit Filed

A second class action lawsuit has been filed against Apple regarding its voice-activated iPhone 4S program Siri, accusing the company of exaggerating Siri’s abilities in its advertising.
The new Siri class action lawsuit, filed in Los Angeles federal court, makes the same basic accusation that the previous class action lawsuit, filed in New York, did – that Apple over exaggerates Siri’s abilities in advertising and TV commercials. According to the New York class action lawsuit, Siri is simply a ploy to lure customers into paying $100 more for the iPhone 4S.
“Through its nationwide multimedia marketing campaign, Apple disseminates false and deceptive representations regarding the functionality of the Siri feature,” the new Siri class action lawsuit alleges. “For example, in many of Apple’s television commercials, consumers are shown using Siri to make appointments, find restaurants, and even to learn the guitar chords to classic rock songs. In its advertisements, Apple depicts these tasks as easily accomplished ‘just by asking’ Siri.”
“Just asking” Siri to accomplish a task isn’t as easy as advertised, lead Plaintiff David Jones says in the class action lawsuit. Often, he says, “Siri would either not understand what [he] asked, or, after a long wait, provided the wrong answer.”
“Apple’s deceptive commercials diverge greatly from the actual functionality and operation of the Siri feature as experienced by Plaintiff and fellow consumers,” the class action lawsuit states.
The new Apple iPhone 4 Siri class action lawsuit is seeking financial relief and damages for Jones and a proposed class of consumers who purchased the iPhone 4S.

UPDATE: On May 3, 2016, Apple urged the 9th U.S. Circuit Court of Appeals not to reconsider a determination that consumer complaints about Siri’s speech recognition capabilities were too vague to justify a class action lawsuit.
