Jean Madeline Aveda InstituteA beauty school associated with Aveda Corp. has been sued for allegedly overcharging customers who received services from cosmetology students.

The class action lawsuit was filed by Sophia Krivy against the Jean Madeline Education Center of Cosmetology Inc., along with Aveda in a Pennsylvania state court for allegedly charging more for haircuts than what is allowed under state law, which says beauty schools can only charge for the cost of materials.

“Defendants employ a uniform policy of charging fees to members of the public for cosmetology services which are much higher than the costs of materials consumed in providing those services,” Krivy says in the Jean Madeline Aveda Institute class action lawsuit.

On Feb. 11, Krivy went to Jean Madeleine Aveda Institute beauty school in Philadelphia to get her hair cut from a student there, for which she was charged $12.00. Krivy alleges that the price she was charged for the haircut “was higher than the cost of the materials.”

“Indeed, even if one tried to amortize the costs of the brushes and clippers and other tools used in providing such a haircut, the cost of such ‘materials’ would be less than $2.00 per haircut, since the same tools can be used hundreds or even thousands of times,” Krivy says in the class action lawsuit.

According to Pennsylvania law, cosmetology schools are not allow to charge for services that are performed by students. The only charge that is allowed is to cover the materials used.

Krivy is looking to represent a class of individuals who claim they were overcharged by any of the three Jean Madeleine beauty schools in Philadelphia since 2008. She is also looking to represent a subclass of individuals who had haircuts at the University City location and paid more than $8.

Krivy’s is charging Jean Madeleine with violating the state’s Unfair Trade Practices and Consumer Protection Law, which would award $100 to each person as a penalty who was violated under the law. It is not required that plaintiffs prove actual fraud, only that the deceptive conduct took place.

The class could make up 5,000 individuals, according to the class action lawsuit, which if true would mean Jean Madeleine would have to pay out a total of $500,000.

Krivy is also asking that Jean Madeleine be forced to end the overcharging practice.

The plaintiff is represented by Stephen DeNittis of DeNittis Osefchen PC.

The Jean Madeline Aveda Institute Class Action Lawsuit is Sophia Krivy v. Jean Madeline Education Center of Cosmetology Inc., et al., Case No. 140202603, in the Court of Common Pleas of Philadelphia County.

    SCHOOL : STUDENT be forewarned!
    I was forewarned by another parent when my daughter decided she was considering going to school here, but dismissed thinking it wasn’t a good fit for her daughter. Should have listened.
    If you are going to commute and as unreliable as septa is, they will make your life miserable..if you are 1 minute late it is considered in 15 minutes increments docked from your time. Which they charged $12 a minute to make up. Apparently they had thousands in overage charges for students forcing Students were dropping out. Now they have done away with charges, they just essentially kick a student out if you miss enough of thier time as semester. Apparently to have students re-register to get more tuition.
    Tuition is a joke, the fees and the “contract” was disregarded halfway through my daughter’s school year and if the students did not sign the new contract they were immediately “dismissed from the program AFTER second payments were made. The entire program was restructured totally disregarding all the students rights. New times, fees and overage charges are just a few.
    The funding they “guarantee” your student will receive is a LIE. Total bait and switch. They “estimate” on the contract how much funding you will receive. The first meeting this young lady who pretty much agreed with everything you ask to sign the contract is a lie. Once you sign up everything they verbally promised is a lie. After my daughter signed the contract we were told none of the funding that was applicable apparently the sheet of funding “attached” to the contract is just an insert and not part of the actual contract! The small amount of fafsa approved funding was RETURNED by the school that the SCHOOL determined we were Not financially in need. Simply because we have jobs!
    The teachers are complete bullies. My daughter is not one to be bullied so they would write her up for everything they could…attire and make her leave when she wore the same black pants for months sent her home midday and charged her their time . For two months made her stand at a stand alone station as a Sr. To do Nothing ALL day trying to make her quit! The entire school is run by incompetent personel. Nothing is legit. The ONLY thing this place cares about is 10 different ways to scam students out of $. They want students to drop out or force to leave to open up room to bring in new students for more tuition. While charging customers ridiculous service fees for a school. Better more affordable legit programs.

    They didn’t send me check I used service when I was visiting my sister, she got check but I didn’t because I live in California, they are asking now proof, which is not require and one should not ask for it. I think they may be checking name and address on some kind of data base and since my address is CA no check,

    As a cosmetologist, what these people don’t understand is that scissors have to be sharpened and that costs money. I’m not trying to justify these prices since I had a horrible time with my Aveda education but I’m just throwing that out there.

    Not to mention, as a matter of fact I’m going to school to be a Lawyer. You know what my niche is gonna be? Its going to be focused on taking law firms to court for bullshit lawsuits :)

    So, let me ask all of you this. When a student in is a Medical intern becoming a doctor and working as a intern, student, what have you, does the hospital not change for the procedures? Does the hospital not charge 50.00 dollars for a Tylenol capsule and 112.50 for a tampon? Plus all the other fees, room and board, Etc. You all need to pull your clouds. What about the interns at a Lawyers office? Karmas a bitch.

    There is an Aveda Institute in Los Angeles, CA also that charges what seems like overcharging prices similar to this one filed in PA. In the LA one they charge $19 for a haircut by a sophomore student, $22 by a Junior student, and $25 for a haircut by a senior student. This hardly seems like beauty school prices by unlicensed students. Highlights at the same place range from $30-$35 and full head color is $45-$50. If anyone, knows if this will also turn into a suit in CA. It seems Aveda has a pattern in this fraud. All info would be helpful.
