Sprint Reaches $19M “Everything Messaging” Plan Class Action Settlement

By Mike Holter

Sprint NextelSprint Nextel announced it will settle a $19 million class action lawsuit filed by customers who claim the company charged them for using cell phones to send pictures, despite having a subscription to Sprint’s “Everything Messaging” plan.

According to the 2010 class action lawsuit, Sprint improperly charged customers for using their cell phones to send pictures and did not properly inform Sprint “Everything Messaging” plan subscribers that the multimedia messages were not included in their texting plans.

We’ve been following the Sprint Not-So “Unlimited” Text Messaging Class Action Lawsuit for over a year.

Sprint denies any wrongdoing, but has offered to pay up to $19 million to settle the class action lawsuit.

Details of the class action lawsuit settlement have not yet been released, but court documents show the settlement includes $3.5 million for legal fees and a $3 million escrow account to “provide monetary relief” to customers covered by the class action lawsuit.

The proposed class action settlement will cover Sprint customers from January 2008 to June 2012, and will give them a choice between free service, fee waivers, credit adjustments, gift cards and cash.

Sighned up last April for “sprints everything plan” have 4 phones and a tab I was also told at that time that I could upgrade in 1 year to new phones . Now im being told that after i signed up that they changed that to 20 months and now it has been past 20 months and they are telling me the no longer do that and u have to pay at least 100.00 per upgrade to and they give u a coupon forwhat your phone is worth. this on top of some of the mystery charges that show up on my bill. My plan is suposed to have free to any other mobile plane and unlimited text I’ve had bills as high as 495.00 for a month and that is without 2 of the phones being lost and not being used
