Brooks Brothers Credit Card Transaction Class Action Settlement

By Matt O'Donnell

Brooks Brothers settlementBrooks Brothers has reached a class action lawsuit settlement over allegations it violated California law by requesting and recording personal identification information from customers during credit card transactions. If you made a credit card purchase at a Brooks Brothers retail store in California between 2010 and 2012 and were asked to provide your address, email, zip code or telephone number, you may be entitled to a Merchandise Certificate worth $25 or $50 from the class action settlement.

The Brooks Brothers settlement will resolve a class action lawsuit, entitled Stathopoulos v. Retail Brand Alliance, that alleges Retail Brand Alliance (d/b/a Brooks Brothers) violated the Song-Beverly Credit Card Act by asking customers for personal identification information during credit card transactions. Brooks Brothers denies any wrong doing, but has agreed to a class action lawsuit settlement to avoid the hassle of ongoing litigation.
Class Members of the Brooks Brothers class action lawsuit settlement include all persons who purchased merchandise with a credit card at any Brooks Brothers retail store in California (including factory/outlet) and were asked to provide or did provide personal identification information such as their physical address, email address, zip code and/or telephone number between June 2, 2010 and June 18, 2012.

As part of the class action settlement agreement, Brooks Brothers has agreed to provide a Merchandise Certificate worth $25 off all merchandise purchases up to and including $200, or $50 off all merchandise purchases over $200, redeemable at any California Brooks Brothers store.

If you received a Brooks Brothers Settlement Notice postcard in the mail, you do not need to do anything further to receive your Merchandise Certificate; it will be mailed to the same address where you received the postcard. However, if you did not receive a postcard in the mail and are a Class Member, you must submit a Claim Form by October 16, 2012 to receive your Merchandise Certificate.

Claim forms and more information on your rights in the Brooks Brothers Credit Card Payment Class Action Settlement can be found at www.BBSettlement.com. Detailed instructions on how to file a claim can be found in our Open Lawsuit Settlements section.
