Apple MacBook Defective Motherboard Class Action Lawsuit

By Mike Holter

MacBook lawsuitA federal class action lawsuit says Apple knowingly sold MacBook laptops with defective motherboards that cause the USB ports to malfunction, but refuses to acknowledge or fix the problem.

According to the class action lawsuit, the integrated circuits, ports, and USB ports reside and operate on the Apple motherboard, known as the “Logic Board,” which is “not fit” for the purposes for which it was intended. “Instead, the Logic Board – because it was negligently designed and manufactured – prematurely fails to work and causes components such as USBs and other ports to malfunction.”

MacBook Pros and MacBooks do not have the intrinsic hardware to operate with a Logic Board, so if it fails, the laptops are rendered useless. Apple is aware of this substantial defect, but failed to disclose it or warn consumers, the class action lawsuit says.

“In some instances, Apple has attempted to hide the defect by limiting the number of USB ports on the Logic Board, rather than repairing the Logic Board itself. This cover-up shows that Apple has knowledge of the defect, yet willfully and intentionally decided to hide the defect, resulting in continuing damage to the Class.”

Furthermore, the MacBook class action lawsuit continues, consumers who take their broken laptops to the Apple Store are told it costs at least $310 to repair the Logic Board, but if they call Apple Customer Relations, they’re told that the Logic Boards will be repaired for free. As a result, millions of consumers have purchased flawed Logic Boards, which prematurely fail and limit the functionality of the laptops, the class action lawsuit says.

The MacBook class action lawsuit is brought on behalf of all consumers who purchased a MacBook Pro or MacBook computer. It is seeking compensatory and/or punitive damages, restitution, injunctive relief and more.

I was told it was my power button took it in and they replaced it and then told me it was the infamous logic board and wanted to send it to Texas and charge me another $400.00 on top of the power button that was $163.00. I told them to put the old power button back in and give it back to me. I tried to sue them in small claims but lost. I can not believe they are getting away with this. They know the part is defective, if it was a car they would be made to fix them. I am also in Massachusetts. Do I have to wait for the court decision before I file a claim?

HELLO, I HAVE JUST READ YOUR DEFECTIVE LOGIC BOARD CASE SUIT PAPERWORK, REGARDING APPLE’S MAC BOOK PRO’S COMPUTER SYSTEM.

ON 07-27-2012 I EXPERIENCED A DEFECTIVE LOGIC BOARD PROBLEM WITH MY APPLE MAC BOOK PRO COMPUTER, AND WAS 1ST INFORMED BY APPLE’S GENIUS BAR TECHS, THAT IF THE MATTER IS A SIMPLE FIX, THERE WILL NOT BE NO COST TO ME. I FURTHER WAS TOLD THAT IF IT IS A HARD DRIVE PROBLEM, AND IT NEEDS TO BE FIXED, THE COST OF REPAIR, WILL BE APPROX. $140.00, AND WAS FURTHER REQUESTED BY APPLE TECH’S THAT THEY NEEDED 48 HOURS TO FIQURE OUT THE PROBLEM…
ON SUNDAY 07-29-12 I RECEIVED A TELEPHONE CALL FROM APPLE GENIUS BAR TECHS, THAT THE PROBLEM WAS NOT WITH THE HARD DRIVE AS PREVIOUSLY STATED FOR $140.00 REPAIR, THE PROBLEM WAS THE LOGIC BOARD, AND THE COST TO REPAIR THE LOGIC BOARD, WOULD BE APPROX. $310.00, AND THAT THE COMPUTER WOULD NEED TO BE SENT OUT TO APPLE’S REPAIR DEPOT, OFF APPLE STORE’S GENIUS REPAIR TECHNICIAN LEVEL.
I FURTHER WAS REQUESTED BY THE APPLE STORE REPRESENTATIVE, THAT IF I HAD AN EXTERNAL HARD DRIVE, TO SAFE MY COMPUTER’S INFORMATION, BEFORE THE COMPUTER WAS SENT OUT TO THE APPLE REPAIR DEPOT, IT WOULD BE BEST TO BRING IT INTO THE APPLE STORE, SO THE GENIUS BAR TECH’S COULD SAVE MY COMPUTER’S STORED INFORMATION, BEFORE THE APPLE DEPOT RECEIVED IT, AND STARTED WORK ON IT, “FOR THE APPLE STORE I WAS DEALING WITH COULD NOT GUARANTEE, THAT MY COMPUTER’S STORED INFORMATION, WOULD BE SAVED BY THE APPLE REPAIR DEPOT,”
SO I BROUGHT IN MY PERSONALLY OWNED 500GB EXTERNAL HARD DRIVE, ON MONDAY 07-30-12, AND REQUESTED THAT THE APPLE STORE GENIUS BAR TECH’S, NOTIFY ME, WHEN THEY WERE ABLE TO SAVE MY COMPUTER’S SAVED INFORMATION, VIA MY PERSONALLY OWNED EXTERNAL 500 GB HARD DRIVE, BEFORE ANY FURTHER WORK, WOULD BE AUTHORIZED, ON MY APPLE MAC BOOK PRO COMPUTER, WHERE I WAS FURTHER INFORMED THAT MY REQUESTED WOULD BE HONORED.
AFTER WAITING APPROX. 04 PLUS DAYS, THAT HAD GONE BY, AND NOT RECEIVING A CONTACT TELEPHONE CALL FROM THE APPLE STORE’S GENIUS BARS TECHNICIANS, REGARDING THE SALVAGING OF MY STORED COMPUTER’S INFORMATIONS, TO MY PERSONALLY OWNED 500GB EXTERNAL HARD DRIVE,
I CONTACTED THE APPLE STORE ON FRIDAY 08-03-12, TO WIT I WAS DEALING WITH, AND INQUIRED, IF THE SALVAGING OF MY COMPUTER’S INFORMATION WAS SALVAGEABLE???
I WAS INFORMED THAT MY COMPUTER’S INFORMATION WAS SALVAGEABLE, AND THAT MY COMPUTER HAD JUST BEEN RECEIVED BACK IN FROM THE APPLE REPAIR DEPOT, A COUPLE HOURS EARLIER, ON FRIDAY 08-03-12, AND THAT THE REPAIR COST WOULD BE $310.00, AS OF THAT
    DATE AND TIME.
I ADVISED THE APLE STORES GENIUS BARS TECHNICIAN THAT I NEVER GAVE PERMISSION TO RELEASE MY COMPUTER, TO THE APPLE REPAIR DEPOT, PRIOR TO THIS PARTICULAR DATE, AND TIME, DO TO THE HIGH REPAIR COST FACTOR, ETC…
I MADE FORMAL VERBAL COMPLAINTS TO UPPER APPLE STORE MANAGEMENT (DAVE)), REGARDING THE INAPPROPRIATE REPAIR TRANSACTION, THE WEEK OF MONDAY 07-30-12 THROUGH FRIDAY 08-03-12…
WHERE MY VERBAL COMPLAINTS WERE, FOUND TO BE USELESS, WITH UPPER APPLE STORE MANAGEMENT, FOR THEY WERE RESTING THERE CASE ON AN INACCURATE LOG NOTE MADE BY 01 OF THEIR GENIUS BAR TECHNICIANS, “WHICH THEY STATED TO ME” THAT “I “ALLEGEDLY GAVE THEM PERMISSION, TO RELEASE MY COMPUTER TO THE APLLE REPAIR DEPOT, ON MONDAY 07-30-12..” AND THAT THE COST OF REPAIR WILL BE $310.00 -(CASE CLOSED!!!)
I EVEN REQUESTED THE RETURN OF MY PERSONALLY OWNED 500GB EXTERNAL HARD DRIVE, IN THE MEAN WHILE…
WHERE I WAS FURTHER INFORMED BY UPPER APPLE MANAGEMENT (DAVE), THAT ” I WOULD RECEIVE MY PERSONALLY OWNED 500GB EXTERNAL HARD DRIVE, ONCE I PAID FOR THE $310.00 APPLE REPAIR DEPOT COMPUTER REPAIRS.”
SO ON SATURDAY 08-04-12, I PAID FOR THE APPLE REPAIR DEPOT’S $310.00 COMPUTER REPAIRS, SO I COULD RETRIEVE, MY PERSONAL COMPUTER PROPERTY, ETC…
“”SO AS A RESULT OF THE TIME FRAME, EXPLAINED ABOVE, AND HOW MY COMPUTER REPAIR WAS TRANSACTED,” “I PERSONALLY BELIEVE THAT APPLE, I UTILIZING,” “BAIT AND SWITCH TACKTICS, ETC..”
AND I HAVE RECEIPT PAPER WORK, TO BACK MY SELF UP, REGARDING THE ABOVE ISSUE…
PLEASE FEEL FREE TO CONTACT ME, ANY TIME REGARDING THE ABOVE RELATED MATER..
    RESPECTFULLY,
