Skechers $40M Toning Shoe Class Action Settlement Preliminarily Approved

Skechers Shape-Ups settlementA federal judge this week tentatively approved a $40 million class action lawsuit settlement between Skechers USA, Inc. and consumers who bought Skechers toning shoes based on ads that made unfounded claims that the footwear would help people lose weight and strengthen muscles. The class action settlement was reached just three months after Skechers reached a deal with the Federal Trade Commission over the deceptive toning shoes ads.

The Skechers toning shoe settlement will provide consumers refunds for their purchases: up to $80 per pair of Shape-Ups; $84 per pair of Resistance Runner shoes; up to $54 per pair of Podded Sole Shoes; and $40 per pair for Tone-Ups. Consumers who purchased these shoes since August 1, 2008 can file a claim to participate in the class action settlement.

The Skechers class action lawsuit settlement covers more than 70 lawsuits filed across the country that were consolidated in federal court in Louisville, Kentucky as Grabowski v. Skechers U.S.A., Inc.

“Skechers’ unfounded claims went beyond stronger and more toned muscles. The company even made claims about weight loss and cardiovascular health,” said David Vladeck, Director of the FTC’s Bureau of Consumer Protection.


In addition to paying out refunds to consumers, Skechers is barred from making claims about strengthening, weight loss, and other health and fitness-related claims for its toning shoes unless they are true and backed by scientific evidence. The Skechers class action settlement also bars the company from misrepresenting any tests, studies or research results regarding toning shoes.

The total refund you can receive from the Skechers shape-ups class action lawsuit settlement will depend on how many Eligible Shoes you purchased since August 1, 2008, as well as the total number of valid claim forms submitted by other Class Members.

love, love, love my skeechers. Saw on the website that of course they are clearancing them so bought 3 more pair at half price. I have owned 3 prior to them. And no, I don't think they aid in weight lose or toning-I just feel they are more comfortable than other shoes.

Just as there is no "evidence" that the shoes are any better for "toning" than any other shoes, there is no evidence that they do any more harm than any other shoes. Anecdotes are not evidence. Use your brains people. However if it stops other products being sold with false claims (ie the entire supplements and cosmetics industries) then that's a good thing

I have just been diagnosed with a stress fracture in my left heel. The only shoes I wear are the sketchers. I won't be wearing them anymore.

I COULD HARDLY TO GET MY SKETCHERS. THE FIRST TIME WALKING IN THEM FELT WEIRD BUT THE MORE I WORE THEM THE MORE AFRAID II GOT THAT I WAS GOING TO HURT MYSELF AND QUIT WEARING THEM.

Someone better do something about the permanent damage issue & quick! I just had to fight with my & 7yr old nephew trying to explain to him that it wasn't right that they could sell these very same shoes to kids telling them they could "jump high" after the company was just sued because the shoes hurt grown ups. He said thru tears thats because grown ups are to tall to wear them, but he would be fine or it couldn't be on t.v. I told him thru my own tears about how they used to tell us kids smoking was fine to but we where kids and didn't no what was bad for us and what was hurting us, and by the time we did the damage was already done. And, the same type of thing would happen to his little legs and back, he would think he was fine, but when he got older, and had pain with every step he took it would do no good to say "see Aunt Jeni wasn't lying to you about those shoes way back when you where 7" . Cause his ligaments would forever be misshapen! Why is it that we are still allowing this product to be sold to our children???

I wonder why no CAS against MBT (Masai Barefoot Technology) the originators of these rocker bottom type shoes. I bought two pairs, possibly in 2005 - maybe earlier, one pair of sandals and a pair of sneakers - the sneaker cost me $260 and I think I paid close to $200 for the sandal. Since Skechers copied their model and health claims, any chance of a Class Action against the original shoe makers - and they're still being produced and sold even though the company is under new ownership.

Well, I guess my comments DIDN't get posted. lol Okay, lets try again. Of greater concern to me about these shoes - rather than it actually doesn't make my butt shrink within a week, is the potential physical harm. I used my only to walk the dogs and hopefully gain a bit more out of my walk. Since then the tendon around my heel (Achilles Tendon?) has been hurting. It's been months, but it's still acting up. From my reading, it appears when you tear or damage them, they never fully recover. When I wake up, it takes about 15 minutes of walking, stretching, warming up, to stop me from hobbling around. I'm just curious if I was the only one that had this issue? And I just noticed that the Captcha stuff is not below here. So I'll copy and then keep trying to repost until it works this time. grrrrrr!

@Kimberly, I believe this is the same settlement from last May. Sign in to your account at the settlement url and you will see whether you have submitted a claim or not.

Sorry, I don't want to repost what I said before. I made a post and hit submit. Then thought to check back. But now I see the "Captch" stuff. For some reason that was not there before. So just wondering if my last comments made it through. It took forever to for it to submit, so perhaps that was the reason? Anyway, let me see if I can read the Captcha's and submti this. :o) Oh, if staff sees this, you can delete it if my other comments made it through.
