Match.com Class Action Lawsuit Gets No Love in Court

Match.comMatch.com daters found no love in U.S. District Judge Sam Lindsay’s court last week when his dismissed the majority of their class action lawsuit alleging the popular dating site duped customers into believing it had millions of subscribers when more than half were inactive, fake or scammers.

According to the Match.com class action lawsuit, filed in December 2010, Match.com breached its contract with users by using false pretenses to lure members of the public to join and pay for Match.com’s services. These false pretenses included keeping thousands of inactive, fake and fraudulent profiles on its dating site to mislead consumers about their chances of finding a mate.

Judge Lindsay ruled on August 10, 2012 that Match.com had not breached its user agreements, finding the pacts do not require it to remove dormant or inaccurate profiles. According to Lindsay, the language of the agreements “in no way requires Match.com to police, vet, update the website content” or verify the accuracy of profiles on the site.

Judge Lindsay dismissed the Plaintiffs’ claims of breach of contract and asked them to explain why he should not also toss out claims of deceptive trade practices brought under Texas law. He gave them until August 27 to respond. If they do not respond by the deadline, the entire class action lawsuit will be dismissed, he said.

Plaintiffs in the Match.com class action lawsuit were hoping to recover any subscription fees current and former Match.com members paid. A copy of the original complaint can be read here.
